Employment Agreement

THIS AGREEMENT, made this ____ day of ________ (month), _____ (year), effective the __ day of ________ (month), _____ (year), CoffeeSir Inc., a company incorporated pursuant to the laws of the National Capital Region, hereinafter called Employer, and (Employees name) __________________________________________, of (Employees addresss) ______________________________________________, hereinafter called Employee.

WITNESSETH: In consideration of the covenants and agreements herein contained and the money to be paid hereunder, the hereby employs the Employee and the Employee hereby aggress to perform services as an employee of the Company, upon the following terms and conditions:

1. DUTIES

1.1 During the period of employment hereunder, the Employee shall devote his/her full time and efforts to the business and affairs of Employer, with the exception of vacation time as provided below.

1.2 The Employee shall use his or her best efforts to promote the interests of his/her Employer, for the benifit of enriching the company even further.

2. COMPENSATION

2.1 The Employer agrees to pay the Employee, during the term of this agreement, a salary given thru a schedule, which salary shall be equal to the net operating income of his/her Employer, as that term is defined in the schedule that will be given.

2.2 The Employee will receive a monthly draw, payable in to two (2) equal installments on the fifteenth (15th) and thirtieth (30th) of each month during the term of this agreement. The amount of every monthly draw will be decided in conformity with the criteria set forth in the schedule that will be given. 2.3 In consideration of the services to be provided by him/her hereunder, the Employee, during the term of his employment, shall be paid a base salary of 8,000 in equal half-monthly installments. In line with this, the Employee is also entitled to receive exclusive benefits in accordance with the Employer's standard benefit package.

3. PERFORMANCE OF DUTIES

3.1 The Employee agrees that during the Employment Period he shall devote his full business time to the business affairs of the Company and shall perform his duties faithfully and efficiently subject to the direction of the Owner of the Company. The Employee shall not be assigned duties and responsibilities that

are not generally within the scope and character associated or required of other employees of similar rank and position.

4. WORKING FACILITIES

4.1 The Employer shall furnish the Employee with facilities and services suitable and comfortable to the the Employee's position and, also, for the betterment of the performance of the Employee's duties and responsibilities.

5. ANNUAL LEAVE/VACATION

5.1 The Employee shall be entitled to an annual vacation as specied to the schedule that will be given, without loss of salary and compensation.

5.2 The Employee shall also be entitled to such additional time without loss of compensation for attendance at meetings and conventions related to his/her Employer's business. 5.3 In addition to the nine (9) Public Holidays, twenty (20) working days holiday is allowed during a full calendar year, 1st January to 31st December in accordance with the provisions of the Organization of Working Time Act, 1997.

6. TERMINATION

6.1 This Agreement may be terminated by the Employer upon the sudden occurrence of any of the following events:

The death of the Employee;

2.

At the Employer's option, the Employee's permanent disability.

The Employee's failure to comply with one of the following specified regulations, terms or conditions: [_________________]

4. The Employer may terminate the employment of the Employee at any time without the requirement to show sufficient cause, if the reason of termination is valid and, therefore, irrevocable. 5. The employee is complied on the agreement to return any recieved property of CoffeeSir Inc. at the time of termination.

6.2 Upon termination for any of the stated causes, the Employee shall be entitled to receive only the right compensation to be acquired.

6.3 If the Employee dies during the term of this employment, the Employer shall give to the household of the Employee the right compensation as payment to his last service to the company.

7. WORKING HOURS AND INTERVALS

7.1 The hours of work shall be 8-10 hours long, or a total number of 60 hours per week, as shall be set out by the Company from time to time. This is in compliance with the Organization of Working Time Act, 1997. 7.2 The Employee is entitled 30 mins of break in order for them to accumulate their meals and to attend other important things related whereof to the company or personal life. 7.3 The employee may be permitted to work beyond the expected time when it is necessary, provided that the daily overtime length shall not exceed to three (3) hours a day or accumulated total of ten (10) hours a week.

8. ABSENCE

8.1 The Employer must be notified as soon as possible before the start of the working hours in all cases where the Employee is unable to attend at the place of work. If it is a physical ailment, a medical certificate is required if the absence extends beyond two (2) consecutive days and must cover the period until the Employee is declared fit to work again. Any medical appointments and other important errands, should, if possible, be done outside working hours.

9. BENEFITS

9.1 The Employer shall give exclusive benifits that will give the Employee a good working experience. Also, the Employer shall at its expense provide the Employee with SSS and Health Plans that is currently in place or as may be in place.

10. PROBATION PERIOD

10.1 It is understood and agreed that the first ninety (90) days of employment shall constitute a probationary period during which period the Employer may terminate the Employee's employment, for any valuable reason without notice or cause.

11.1 . CONFIDENTIALITY

11.1 During and after the Employment Period, the Employee will not share or dissimenate, in competition with the Company, any secret or confidential information or knowledge pertaining to the business and operations of the Company, obtained by him in any way while he was employed by the Company. Proper punishments and amends shall be intact and be strictly implemented.

12. APPLICABLE LAW

12.1 The provisions of this Agreement shall be construed in accordance with the laws of the Republic of the Philippines and the National Capital Region.

13. EMPLOYMENT PERIOD

13.1 This contract is valid from ______ (MM/DD/YY) until ________ (MM/DD/YY). Extension of contract is based on the employees performance and decision of the employer. Any decisions made by the employer is absolute and irrevocable.

14. ENTIRE AGREEMENT

14.1 This agreement contains the entire agreement between both parties, understanding all respects of any and all prior oral or written agreements pertaining to the employment of the Employee by the Employer and shall be amended only by written instrument signed by both of the parties. Any agreed upon decisions by both parties are final and irrevocable.
