INTRODUCTION The Prosecution seeks leave to adduce a written statement of General Sir Rupert
Smith (RM512) (Amalgamated Statement)1 pursuant to Rule 92ter of the Rules of Procedure and Evidence (Rules). The proposed evidence satisfies the admissibility requirements of Rule 92ter (A) and follows the guidance given by the Trial Chamber. 2. The Prosecution also seeks the admission of 56 associated exhibits referenced in
the Amalgamated Statement pursuant to Rule 92ter as part of General Smiths evidence in this case.2 II. 3. APPLICABLE LAW The Prosecution incorporates by reference its summary of the applicable law set

THE TRIAL CHAMBER SHOULD ADMIT RM512S AMALGAMATED STATEMENT PURSUANT TO RULE 92TER The Amalgamated Statement satisfies all of the admissibility requirements of General Smiths

General Smiths Amalgamated Statement was developed from his extensive testimony and review of relevant documents in the Slobodan Milo{evi}, Dragomir Milo{evi}, Popovi} et al. and Peri{i} cases.4 General Smiths extensive evidence has been concentrated into the 62-page Amalgamated Statement by efficient use of associated exhibits, and the most relevant of those exhibits are requested for admission alongside the statement. The selected exhibits are integral and necessary to a full and fair understanding of General Smiths evidence. They comprise various categories of documents, notably documents written or received by General Smith; other UNPROFOR reports and records of events described in the Amalgamated Statement; contemporaneous RS and VRS documents whose content corroborates and confirms General Smiths recollection of events as he witnessed them; and other records (e.g., intercepted communications and video footage) which detail events in which General Smith was a participant or otherwise witnessed.
