Strategic Functions of TRAI

TRAI is The Telecom Regulatory Authority of India which was formed in January 1997 with a
view to provide an effective regulatory framework and adequate safeguards to ensure fair
competition and protection of consumer interests. The Government is committed to a strong
and independent regulator with comprehensive powers and clear authority to effectively
perform its functions.
Main functions of TRAI are:
(a) protect and promote the interests of the consumers and
(b) ensure fair competition.
TRAI monitors and determines the appropriate tariff structure on an ongoing basis to equitably
protect the interest of consumers and industry. The TRAI ensures the availability of
interconnect on a non-discriminatory basis.
• TRAI will be involved in the dispute settlement between Licensor and Licensee to
speed up the process of resolving any disputes.
• Clarify that the dispute arising out of such licensing conditions that involve fulfilment of
obligation by DoT as service-provider would fall within the jurisdiction of TRAI which
also includes:
• need and timing for introduction of new service provider
• revocation of license for non-compliance for terms and conditions of license
• measures to facilitate competition and promote efficiency in the operation of
telecommunication services so as to facilitate growth in such services.
• efficient management of available spectrum
• Though legally not mandatory, Government will normally seek recommendations from
the TRAI on need and timing of new licenses and other important policy matters relating
to development of Communications industry. These recommendations, however, will
not be binding on the Government.
Telecommunication is a vital infrastructure. It is also technology intensive. It is, therefore,
necessary that the administration of the policy in the telecom sector is such that the inflow of
technology is made easy and India does not lag behind in getting the full advantage of the
emerging new technologies. An equally important aspect is the strategic aspect of telecom,
which affects the national and public interests. It is, therefore, necessary to encourage
indigenous technology, set up a suitable funding mechanism for indigenous R&D so that the
Indian Technology can meet the national demand and also compete globally which is a
function of TRAI.
