Rafael vs. Embroidery and Apparel Control and Inspection Board 21 SCRA 336, Sept 29.

Facts: In 1961, Republic Act No. 3137 was passed. This law created the Embroidery and Apparel Control and Inspection
Board (EACIB). Section 2 thereof also provided that the members of the Board shall be composed of Bureau of Customs,
Central Bank, Department of Commerce and Industry, National economic council, and Private sectors. The petitioner ask
to invalidate the RA 3137, due the provision in the law which provides the composition of the board.
Issue: WON the Members of EACIB those who are holding government position are violating the provision under the Sec
13 Art. 7?
Ruling: No, the bureau performs functions which have direct relation to the importation of the raw materials. The Court
said that the RA3137 does not contradict the provion on the sec13, and therefore declared constitutional.
