ORDER FOR IN-CAMERA SUBMISSION ON


DEFENDANT GONZALEZ’S MOTION TO COMPEL DISCLOSURE

After considering the submissions of the parties on Defendant Gonzalez’s Motion

to Compel Disclosure (Docket # 143) of the identity of the “CI in Austin, TX”, the Court

finds that it is necessary to have additional information in order to rule on that Motion.

Accordingly, it is hereby ORDERED that the Government to file, on or before February

12, 2008 an in-camera written document: (1) indicating the identity the confidential

informant, (2) indicating whether the Government intends to call the confidential

informant as a witness at trial, (3) explaining the informant’s role in the investigation of

this case, (4) describing the information the informant provided to the Government, and

(5) explaining the Government’s decision to withhold the informant’s identity from

Gonzalez and the other Defendants in this case.
