PUBLIC NOTICE
Permit Application No. SAJ-1995-00155(MOD-MLC)

TO WHOM IT MAY CONCERN: This District has received a


modification request for a Department of the Army permit
pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344)
as described below:

APPLICANT:

WATERWAY & LOCATION:

The existing mitigation bank is located west of the Turkey Point


Facility, east of Card Sound Road in Miami-Dade County, Florida.

Geographic position:

Latitude 25' 21' 10.2347"/Longitude -80" 23' 58.3092"

PROPOSED MODIFICATION:

Via correspondence dated, May 8, 2009, Florida Power & Light


(the permittee) has requested a modification to the existing
Everglades Mitigation Bank, Phase 2, to expand the mitigation
bank service area to the Florida Keys (Monroe County). The
current service area encompasses Miami-Dade, Broward and the
majority of Palm Beach County (map attached). The applicant has
requested the modification because of the proximity of the
mitigation bank to the Florida Keys. The downstream benefits of
the mitigation bank may improve the Card Sound and Barnes Sound.
Additionally, there are no permitted mitigation banks in this
area. No additional credits are being generated from this
modification request and the functional assessment Wetland
Assessment Technique for Environmental Review (WATER) would
continue to be utilized, should the modification be approved.

Comments regarding this application should be submitted in


writing to the District Engineer at the above address within 30
days from the date of this notice. Although the public notice
comment period ends in 30 days, the Corps permit decision may
not be made for several weeks after that date as a result of
necessary coordination regarding endangered species and/or
essential fish habitat as well as heavy permit evaluation
workload.
