Second Assignment recorded 2/8/2008 from Option One to Wells Fargo as Trustee for Option One Mortgage Loan Trust 2007-5 Asset backed Certificates Series 2007-5. Assigns mortgage and note(s). Executed in Dakota, Minnesota.... LOL (Land of LPS). 1st Order of Notice recorded 4/28/2008 by Korde and Associates 2nd Order of Notice recorded 9/15/2010 by Korde and Associates. Same exact information on both. Time really does stand still. What could that imply I wonder? The info was run through a certain database.... OOPS!! The cutoff date for the Trust was 4/1/2007: April Fool's!! No, that really is the date. Closing date of said Trust was on or about 4/27/2007. Conclusion? The assignment to Option One is not only invalid, it was executed well beyond the closing date of said TRUST. THEREFORE... this would be another REMIC FAIL. Not to mention there are a few crucial assignments missing here. You waited four years to try this? Where the heck is the IRS when you really need them??!! The Trust stopped reporting (15D) on 1/25/08. The assignment to Wells Fargo as Trustee is 1/30/2008. Get out the calculator's!! That's five(5) days later, for those who don't want to get up.
