ORDER ON STIPULATION TO CONTINUE HEARING SETTING ON MOTION FOR RELIEF FROM THE AUTOMATIC STAY, TO THE EXTENT APPLICABLE, TO ALLOW PAYMENT AND ADVANCEMENT OF PROCEEDS UNDER INSURANCE POLICY This matter comes before the Court on the Stipulation to Continue Hearing Setting ("Stipulation") on the Motion for Relief from the Automatic Stay, to the Extent Applicable, to Allow Payment and Advancement of Proceeds under Insurance Policy (the Motion), filed by Cordillera Golf Holdings, LLC, WFP Cordillera, LLC, CGH Manager, LLC, David A. Wilhelm and Patrick Wilhelm (the Movants), proposed between the Movants and the Official Committee of Unsecured Creditors appointed in this bankruptcy case ("Committee"). The Court having reviewed the Stipulation, IT IS HEREBY ORDERED, ADJUDGED, AND DECREED THAT: 1. The Stipulation as between the Movants and Committee is APPROVED, the hearing date selected by Movants on the their Motion for October 18, 2012, at 9:00 a.m., is continued to October 23, 2012, at 1:30 p.m., and if the Committee or Debtor orally object to the Motion, the Court shall set a time by which either can file a written response to the Motion and a prompt L.B.R. 4001-(c) hearing;

At the hearing, the Committee and Debtor shall be allowed to make verbal objections to the Motion notwithstanding the objection deadline of October 11, 2012.

Movants are deemed to have waived their rights under 11 U.S.C. section 362(e); and Movants shall forthwith serve a copy of this Order on Counsel for Debtor and the Committee.
