This sample stipulation and order for California is used when both parties to a lawsuit wish to sign a stipulation which is then signed by a Judge and filed with the Court. This particular sample was used to stipulate to having a default entered against a defendant vacated, and allowing them to file an answer to the complaint. The sample can be modified for use in any litigation case in California. The author is a freelance paralegal who has worked in California litigation since 1995 and has used this sample for many years.
