Asm. Diane Papan last week introduced a Cal Cities-sponsored bill that would improve the housing element review process for both the state and local governments.
"This bill is about accountability and fairness," said Papan. "By improving coordination and ensuring timely feedback, AB 650 will help hold accountable all parties for their respective roles in developing proactive housing elements that will yield real results."
The bill takes a three-pronged approach. First, AB 650 would allow cities to begin updating their housing elements six months early. It would also require the Department of Housing and Community Development (HCD) to detail how a city can comply with state housing element law to receive certification. Finally, it would ensure cities are not penalized when HCD identifies issues not identified in prior review letters.
State law requires cities to plan and zone for housing, as determined by the Regional Housing Needs Allocation (RHNA). As part of this complex process, cities must submit data, actions, and programs that promote fair, equitable, and affordable housing in their communities. Currently, local jurisdictions are planning and zoning for nearly 2.5 million new homes statewide.
Cal Cities hosted multiple roundtables last fall with members to better understand the challenges cities face getting their housing elements approved by HCD. Common issues include a short timeline for completing documents and responding to HCD's feedback, a lack of clarity from the state when it reviews revised draft plans, and new requirements added late in the process.
