“Having an IEP has enabled my daughter, who wears bilateral cochlear implants, to receive the services and accommodations she needs to be successful in a mainstream classroom.” - Anonymous Parent As your child turns three, they transition from Early Intervention to special education in your local school district. Understanding Individualized Education Plans (IEPs) is crucial for tailored support, including literacy. Your service coordinator guides this transition, evaluating needs for an IEP, 504 plan, or no accommodations. An IEP goes beyond mere accommodation; it's a personalized plan addressing learning challenges during academic changes, protected under the Individuals with Disabilities Education Act (IDEA). Associate Attorney at Hawley, Troxell, Ennis & Hawley, licensed in Idaho, Utah, and Wyoming. Specializing in litigation, special education law, and insurance defense.
Principals, Special Education Directors, and School Districts: Special education teachers, general education teachers, and parents should be working together to education students with disabilities in the "Least Restrictive Environment ("LRE"). Students with disabilities should be educated to the maximum extent with students who are not disabled. The 9th Circuit has established the "Rachel H" test to assist in determining whether the student's placement is the LRE. The Rachel H test includes consideration of: 1. Educational benefits in regular classroom supplemented with appropriate aids and services; 2. Non-academic benefits of interaction with typical peers; 3. Effect on teacher & children in the regular education classroom; and 4. Costs of providing the supplementary aids and services necessary in the regular classroom. Make sure to provide a thorough analysis for each of these elements next time you are determining the placement of a student. #specialeducationlaw #specialeducation #education #schooldistricts

What comes to mind when you hear of persons with Special needs? I was with a lady who claimed she studied special education recently, and the only categories of special needs she seems to know, is Deafness and Blindness. I was surprised, just as you might be. Special needs can be categorised In various needs, which include physical, Cognitive, psychological, medical, developmental, learning, communication, and behavioural needs; each of this listed categories includes diverse disabilities and conditions that affect an individual ability to function to an optimal level. What other special needs do you know aside Deafness and Blindness? #specialeducation #specialneeds #abilitynotdisability #specialeducator

Attention Parents! Your involvement in your child's education is paramount, and the IDEA stresses this importance. However, be aware that schools restricting your role in IEP meetings or decisions could violate your rights and your child's right to FAPE. If you're ever pressured to sign an IEP without proper understanding or find yourself being left out of important conversations about your student’s education, it's time to act. Know your rights and stand up for your child's education! #éclatLaw #EducationLaw #ParentalRights #SpecialEducation #IEP #FAPE

Despite the importance of training teachers in inclusive in-service education and its role in improving their knowledge, skills and attitudes, pre-service training is of greater importance as university education programs are still traditional and deal with disability through the lens of disability and not by adopting a human rights approach. I believe that we need a transformative approach in university education programs to train teachers to teach people with disabilities within a diverse, fair, participatory, and supportive educational environment, not isolating environments. #Inclusive_education #Jordan #education_reform
