What issues arise when arbitration meets digital technology? The sun came out on a gloriously beautiful day while I was on leave in London yesterday, adding to the brilliant time I had engaging with the 75 participants of this year’s edition of the London Summer Arbitration School. Comprised of private practitioners, judges, in-house lawyers, government officials, PhD candidates and students, this year’s participants consisted of nationals from 41 countries — one of the most diverse groups I’ve had the pleasure of meeting. We got off to a running start on Arbitration in the Digital Economy, discussing the topic from the two perspectives of - novel substantive legal questions that would arise in proceedings brought to arbitration involving the broad scope relating to the digital economy — claims on digital assets, issues arising out of autonomously executed contracts, artificial intelligence systems, transactions on digital platforms; and - use of digital technologies in arbitration, including electronic notification, video hearings and cross examination, the transmission of documents and awards, the use of immersive technologies for hearings, and the use of artificial intelligence in the writing of submissions, pleadings and awards. It’s always such a pleasure to be back in one of my home cities, and to be a part of the wonderful programme organised by Anna Petrig and Yarik Kryvoi of the Arbitration Lab. The participants were so engaged and engaging, and I always find that I learn so much from these interactions. (And one of the highlights for me in particular is the flying lunch with James Clanchy — this must become an annual tradition!) Thanks for having me! Our Partner, Nitin Jain, represented Agama Law Associates at the 2024 HKIAC Global Event, where leading minds from around the world convened to explore important arbitration trends and the evolving legal landscape across cultures. The Role of AI in Arbitration The use of AI in arbitration was one of the key points of discussion and debate, highlighting how arbitrators have already begun utilizing AI in the arbitration process. A real-time walk-through experience was shared as well. China's Rise in Arbitration and Cross-Cultural Comparisons The event highlighted China’s impressive rise in arbitration, with approximately 35,000 cases filed with renowned arbitration institutions last year in PRC Mainland and HK, many of them being resolved through conciliation. This shift underscores a move towards a more collaborative approach in the Eastern legal system, in contrast to the Western preference for individualistic dispute resolution rooted in 18th-century thought. Korea’s legal landscape was also a focal point, showcasing a more cautious approach influenced by fiduciary duties, which led to hesitancy in settling disputes. Additionally, the event presented fascinating cross-cultural legal similarities, particularly the shared principles between French laws and common law countries. Diversity in Arbitration and Governance Trends The new HKIAC 2024 rules, emphasizing the inclusion of co-arbitrators to promote diversity in arbitration, were a significant topic of discussion.
