Even if the aim of this new legislation is well-intentioned - who is not against discrimination - a lot of damage will be done by this restrictive regime. It is not a "launch pad ... to lead the global AI race" (Thierry Breton, EU commissioner), but potentially too high a burden for innovative companies that may now consider other locations for their business activities. It is incomprehensible why a #riskbased approach for the use of AI is not being proposed, but rather a direct shot at the technology itself. For example, the potential ban on the use of AI for scoring the economic situation is a major obstacle to the use of Machine Learning for credit scoring, if not a killer. Once more, some regulatory bureaucrats risk regulating the EU into #stagnation and economic insignificance with well-intentioned but unsuitable regulation on top of legislation such as the Data Act. It is to be hoped that the implementation of this legislation will refrain from making the worst mistakes and that the damage will be minimized. The council of the European Union has officially approved the artificial Intelligence (AI) Act on Tuesday 21 May 2024, a landmark legislation designed to harmonise rules on AI within the EU. This pioneering law, which follows a “risk-based” approach, aims to set a global standard for AI regulation. Marking a final step in the legislative process, the Council of the European Union today approved the EU AI Act. In March, the European Parliament overwhelmingly endorsed the AI Act. The Act will next be published in the Official Journal. The law begins to go into force across the EU 20 days afterward. Matthieu Michel, Belgian Secretary of Digitalization, said "With the AI act, Europe emphasizes the importance of trust, transparency and accountability when dealing with new technologies" Before a high-risk AI system is deployed for public services, a fundamental rights impact assessment will be required. The regulation also provides for increased transparency regarding the development and use of high-risk AI systems. High-risk AI systems will need to be registered in the EU database for high-risk AI, and users of an emotion recognition system will have to inform people when they are being exposed to such a system. The new law categorises different types of artificial intelligence according to risk. AI systems presenting only limited risk would be subject to very light transparency obligations, while high-risk AI systems would be authorised, but subject to a set of requirements and obligations to gain access to the EU market. AI systems such as, for example, cognitive behavioural manipulation and social scoring will be banned from the EU because their risk is deemed unacceptable. The law also prohibits the use of AI for predictive policing based on profiling and systems that use biometric data to categorise people according to specific categories such as race, religion, or sexual orientation. To ensure proper enforcement, the Act establishes: ➡ An AI Office within the Commission to enforce the rules across the EU ➡ A scientific panel of independent experts to support enforcement ➡ An AI Board to promote consistent and effective application of the AI Act ➡ An advisory forum to provide expertise to the AI Board and the Commission Corporate boards must be prepared to govern their company for compliance, as well as risk and innovation in relation to the implementation of AI and other technologies. At the political trilogue on 24 October 2023, there seemed to be a consensus to introduce rules for foundation models based on a tiered approach by introducing tighter rules for the most powerful models that are likely to have more impact on society. EU countries today agreed on the technical details of the AI Act, the world's first attempt to regulate the technology according to a risk-based approach, following a political agreement in December. The European Parliament added a new article with an extensive list of obligations to ensure these systems respect fundamental rights as the EU executive’s plan included no provisions for foundation models. The Act will go in front of the European Parliament for formal approval in the coming months, with a plenary vote expected in April. As anticipated last week, Today March 13, the EU Artificial Intelligence Act #AIACT was approved by European Parliament on a 523-46 vote. Now the text needs to be localized into various languages by the lawyer linguists and final text approval will likely happen sometime in April and putting the entry into force date closer to May. As I am strong believer in #versioning and #progressvsperfection, I think this is a great milestone towards a regulation that aim to promote the uptake of human-centric and trustworthy AI innovation, while ensuring a high level of protection for health, safety, fundamental rights and environmental protection against harmful effects of artificial intelligence systems. So organizations should take a proactive approach by becoming familiar with how the AI Act will affect their work now!

Having had a look on the recent political agreement on the AI Act, a closer look shows that the implications for compliance will need a lot of clarification ahead. While the EU AI Act is designed to be a comprehensive cross-sector regulation, ensuring AI systems are safe and aligned with EU values, the reality may be somewhat different. The act is expected to generate an extensive array of formal and informal regulations, presenting a challenging landscape for compliance. The need for detailed testing, documentation, and transparency for high-risk AI systems could complicate procedures. The multitude of market surveillance authorities that can enforce the AI act could make the EU market a complex web for AI developers to navigate.
