I just delivered the closing keynote at #RelativityFestLondon where we discussed Legal Data Intelligence with Briordy Meyers, J.D., CIPP/E, Julia Hasenzahl, and Adam Weiss. The opening keynote, which included Phil Saunders and Chris Brown among others, set things off on an energetic, inspiring note throughout the day. Some of the topics we covered in the closing keynote: 1. The legal industry is at a turning point, with AI being a catalyst for change. Attorneys and legal professionals who don’t embrace technology will be left behind. 2. GCs are eager to invest in team members who develop skills to apply technology (increasingly AI) to tackle legal data challenges and take advantage of 10x efficiency and productivity opportunities while ensuring a legal, ethical, responsible, and defensible approach to legal data. 3. The only thing that’s new about Legal Data Intelligence is its name: this trend has been emerging for a while! 4. We heard LDI case studies from innovative lawyers like Briordy who successfully applied their skill sets to new challenges like GDPR compliance and PI detection, and experts like Julia who have done the same with data remediation and defensible deletion. 5. The cost of inaction is higher than the cost of action. What was your biggest takeaway from #RelativityFestLondon?

With the rapidly evolving #digital market, companies operating in the digital space are facing new challenges that require careful consideration and #compliance. #Businesses must continually adapt to keep up… In light of recent information about new probes under the #DMA and the DSA, and the growing interest in enforcement of the draft #AI Act, Pauline Kuipers, Saskia King, Marcin Alberski, and Reshmi Rampersad of Bird & Bird decided to explore what investigatory powers are available to the #European Commission and local authorities under these regulations, and more specifically how the enforcing authorities can conduct dawn raids to collect information about practices infringing the said regulations. The article published on the Kluwer Competition Law Blogs examines what triggers such inspections, who can be inspected, and how such inspections differ from what we know in #competition law enforcement.

Last week I had the pleasure to go to the AI & Data Protection Conference, organized by the eLaw Center for Law and Digital Technologies. Super interesting panels and discussions on the EU AI Act, the GDPR, fundamental rights' protection and comparative perspectives around the globe. Thanks to Gianclaudio Malgieri for the opportunity and congratulations on organizing such a high-quality event! I presented a piece I've been working on with my colleague and co-author Diego Machado, entitled "Is that a fully automated decision? A comparative analysis on ADM systems’ regulation under Brazilian and EU data protection law". Our paper analyzes the concept of automated decision-making in Brazil, comparing it with the European Union's perspective. We explore the concept of ADMs, including both its technical and legal aspects, and examine art. 20 of the Brazilian General Data Protection Law (LGPD), hopefully providing an understanding of ADM principles and their application. We review the theoretical foundations of ADM, the components of “decisions solely based on automated processing,” and the data subjects’ rights involved in this issue. Using legal comparison (functional equivalence), we tried to highlight parallels and contrasts between the European Union and Brazil, particularly the GDPR's influence on the LGPD. Additionally, we studied how European and Brazilian institutions regulate ADM, offering insights into legal system convergence/harmonization. Our hope was to contribute to discussions on ADM adequacy and conceptual interoperability, aiming to inform and to guide future legislative and regulatory processes in Brazil. In a way, I think our research is actually about the Brussels' effect, and hopefully we'll be able to publish its contents soon. If you're also working on this topic, please reach out!
