I'm encouraged by the rate of ethics guidance being handed down to lawyers seeking to integrate AI into their practice. 📚🤖 💡 While I don't always agree with the approaches taken and believe that some of the guidance is too limiting, it's heartening to see bar associations acknowledging the rapid pace of change and stepping up to help lawyers acclimate. ➡ One example is the Kentucky Bar Association's recently issued preliminary Ethics Opinion KBA E-457, which I wrote about in my latest Daily Record column. ✅ Key takeaways include: Technology Competence: Lawyers must stay updated on AI advancements and maintain client confidentiality. 🛡️💼 Flexible Guidance: Recognizing the rapid pace of AI development, the Committee avoids rigid rules, advocating for adaptable AI policies within firms. 🌐📈 Client Communication: Takes a moderate approach to disclosing AI use, focusing on transparency only in specific circumstances. 🗣️📝 Billing Practices: Provides recommendations for adjusting fees when AI enhances efficiency and ensures clients are aware of AI-related expenses. 💸⚖️ Supervision: Emphasizes the duty of partners and managers to train and supervise ethical AI use. 👥🔍 AI is reshaping our profession, and staying informed is a must in order to provide efficient and effective client representation.
