Yesterday was a busy day for the #TenthCircuit and #criminalprocedure #opinions. So, there will be three posts today. This is post 1 of 3. First up: USA v. Baker, No. 23-8042. In Baker, the Court confronted a suppression issue. A police officer pulls over a speeder. The officer suspects the speeder is transporting drugs in his car, but the K9 unit is more than an hour away. So, the officer lets the speeder go with a warning then proceeds to follow the speeder/suspected drug trafficker for 50 miles while calling the K9 officer to meet up with them. Once the speeder exceeds the speed limit a second time, the initial officer pulls him over again, deploys the K9 unit, and -- after a positive hit -- finds 1,093 fentanyl pills and 2.3 ounces of cocaine. Was there an unreasonable extension of a traffic stop to conduct a dog sniff under Rodriguez v. United States, 575 U.S. 348 (2015)? Short answer: unlawful seizure/traffic stop only occurs if the officers (1) "divert[ ] from the traffic-based mission of the stop to investigate ordinary criminal conduct" in a way that (2) "prolongs (i.e., adds time to) the stop" and (3) without reasonable suspicion supporting the "investigative detour." According to the majority, the facts here are unremarkable and acceptable. Even when considering that the initial officer *did not* order the speeder out of his vehicle during stop #1, but did so during the pretextual stop #2. So, this situation is kosher. Judge Richard Federico (who took the bench in December 2023) dissents. While begrudgingly accepting binding Supreme Court precedent (Whren v. United States, 517 U.S. 806 (1996)) that pretextual traffic stops are okay, Judge Federico writes: But even in an objective inquiry, we cannot ignore the obvious facts and circumstances to render strained judgments solely in the name of officer safety. In the reasonableness balance, the individual’s right to personal security, secured by the Fourth Amendment, demands more. And, in a revealing footnote, Judge Federico says the quiet (true) part out loud: This Court must faithfully apply Whren, which has been the law since 1996. However, I think it is also imperative to acknowledge that studies have “found that drivers of color are more likely to be subjected to pretextual stops than [w]hite drivers.” United States v. Hunter, 88 F.4th 221, 228 (3d Cir. 2023) (McKee, J., concurring) (citing Stephen Rushin & Griffin Edwards, An Empirical Assessment of Pretextual Stops and Racial Profiling, 73 Stan. L. Rev. 637, 637–38 (2021)). Yup. Perhaps, it is time to stop giving officers a free pass when they use deceit and dissembling to trap (at least) motorists? NYC's "Smokeout Act" to close illegal cannabis shops has been long overdue. The most urgent issue related to cannabis in NYC is the proliferation of unlicensed cannabis operations from cultivation, manufacturers and retail operations. Not only does the existence of illegal operations create unfair competition to legitimate operations, it poses a significant threat to public health and safety. There are no quality control processes in an unregulated illegal operation, leaving products exposed to the risk of contamination of pesticides, heavy metals, insects, placing consumers in harm’s way.
