Here is another angle from the law perspective. If the 173-year-old law applies, claims payments could be significantly lower than what the pundits are estimating. When dealing with insurance claims, it is imperative to first understand the provisions of the insurance policy, and then the applicable law(s). As most insurance professionals know, an insurance policy is a contract between the insured and insurer. Furthermore, the policy contains conditions, including conditions precedent; warranties, exclusions, and definitions. All of these coupled with the applicable law affect as to how a claim is handled and paid. What is my fascination with Insurance Law? Please stay tuned for a mid-April post.

After a business perfoms a service aren't they entitled to be paid? A business that doesn't sell a product only a service now can't charge for their labor and time if the customer cancels within 30 days? If you've litigated a contract dispute in Maryland, you've likely referred to the "four corners" rule. This rule, as commonly understood, means that a court interpreting a contract is confined to the language within the "four corners" of the document and can only consider extrinsic or "parole" evidence if the language is ambiguous. But, as two recent opinions from the Supreme Court of Maryland clarify, this common understanding is not entirely correct. Some extrinsic evidence is fair game during a court's initial "four corners" review.
