𝗘𝘅𝗲𝗰𝘂𝘁𝗶𝘃𝗲 𝗢𝗿𝗱𝗲𝗿 𝗼𝗻 𝗔𝗜: 𝗦𝗮𝗺𝗲 𝗚𝗼𝗮𝗹, 𝗗𝗶𝗳𝗳𝗲𝗿𝗲𝗻𝘁 𝗦𝘁𝗿𝗮𝘁𝗲𝗴𝗶𝗲𝘀 In the race for global AI governance, the U.S. and the EU passed legislation to regulate AI within months of each other. Comparing these two approaches reveals significant differences. Similarities are: • Goals: Both stress the importance of trustworthiness, cybersecurity, and data privacy. • Focus on foundation models: Technologically advanced implementations of AI are subject to the most significant compliance requirements. • Transparency: Providers of AI tools must publish certain technical specifications or results of safety tests. Services that utilize AI must disclose this to the user. • Monitoring: Even after release, AI tools must be monitored to ensure the previously mentioned goals are reached. Companies will, however, notice important differences: • Scope of application: The Executive Order is not binding for the private sector, unlike the AI Act. • Enforcement: The AI Act will be enforced by national authorities like the national data privacy commissions. Companies can be fined up to EUR 35 billion or 7 % of their global revenue. • Risk-based approach: The AI Act adopts a risk-based regulatory framework, categorizing AI systems by risk level. • Specific technical requirements: The Executive Order aims to create industry standards and proposes specific security measures, such as sandboxing and red-team safety tests. The U.S. and EU’s approaches both aim to balance innovation with citizen protection. The EU's stringent compliance regulation contrasts with the U.S.'s emphasis on promoting industry growth. The Executive Order is therefore mostly in line with the voluntary safety commitments of e.g., Microsoft, OpenAI and Google.

Aug 1st 2024 - The day to remember in history for future as the European Union has implemented the world's first comprehensive regulation on artificial intelligence, known as the AI Act. More to look out on this act. On August 1, 2024, the EU AI Act officially came into force, marking a groundbreaking step in global AI governance. This regulation, the first of its kind, categorizes AI systems into three risk levels: unacceptable, high, and low. 1. Unacceptable Risk: Systems like social scoring and manipulative AI are banned. 2. High Risk: Includes recruitment tools and biometric identification, requiring strict transparency and security measures. 3. Low Risk: Subject to lighter regulations to encourage innovation while ensuring safety. For businesses, particularly those developing high-risk AI, this means adhering to new compliance measures, including thorough conformity assessments. Non-compliance can result in substantial fines, similar to GDPR penalties. In the cybersecurity realm, the Act mandates robust protections to secure AI systems against vulnerabilities, setting a potential global standard for safe AI development and deployment.
