Laugh-out-loud moments are rare in law practice but the irony of this one got me. Big law firm Winston & Strawn and boutique law firm Hsuanyeh Law Group represented different clients being sued by the same plaintiff for patent infringement. W&S copied Hsuanyeh's motion-to-dismiss pleading word-for-word and filed it in Court a day after a W&S lawyer told a Hsuanyeh lawyer through WeChat that their work was "impressive". Hsuanyeh sued W&S for copyright infringement with a strong enough argument that W&S surrendered. Two things I've never seen before: - someone claim copyright on a pleading filed in Court; - an intellectual property lawyer plagiarize a pleading (about infringement!). Obliviously complimenting its author - chef's kiss.

Prepublication review is an under-utilized way to minimize legal risk and expense. It involves having a lawyer like me read through the manuscript of your book/article/blog post/whatever to help flag and avoid potential copyright, trademark, publicity rights, defamation, or other problems. It’s the publishing industry’s version of “an ounce of prevention” versus the “pound of cure” that is litigation. And for me, it’s a satisfying way to be a part of your team and to help you make your work product the best it can be.
