Due to popular demand, we are honoured to extend an invitation to a third session of our webinar series, "Tax Consulting South Africa's Annual Budget Update for HR, Remuneration, Tax, and Payroll Professionals," on 12 March 2024 at 10:00 AM (SA Time). During our previous webinar, we conducted a thought-provoking poll, asking attendees, "As a Payroll Professional, what do you think about the change on monthly submissions out of 10?" The results highlighted a significant inclination towards caution among respondents, with 81.44% attendees rating the budget's impact on the nation's economic future between 1 to 5 out of 10, suggesting scepticism regarding its benefits. Conversely, a smaller segment, 18.56%, viewed the budget more favourably, rating its potential impact between 6 to 9 out of 10, indicating a degree of optimism about its efficacy. Remarkably, none of the respondents perceived the budget as perfect, with a 10/10 rating absent from the poll outcomes. This distribution of perspectives underscores the community's complex views on the fiscal strategy's potential repercussions. Yesterday afternoon at Pacheco Center in Brussels it was all about taxation!🔍 Interesting updates & panel discussion related to challenges linked to remote working of cross border workers held by panel members from OECD, NL & BE tax authorities, DG TAXUD, academics and lawyers. 💡In a nutshell: ➡️The taxation of wages in case of teleworking by cross-border workers: Current rules with taxation in the country of residence for income generated in that state due to telework (except for minor exceptions like 34 days) are too complex. Potential alternatives in the pipeline: 📌Exclusive taxation in the country of residence; 📌Exclusive taxation in the country of employment; 📌Taxation in the state of residence + withholding tax in the country of employment; 📌Threshold rule (exception on a particular Nr of days/%): this option could offer an alignment with social security rules if a threshold of 50% would be adopted. I personally agree that this alternative could offer the biggest simplification. ➡️The evidence a cross-border worker needs to present: current approach in BE is actually too strict in comparison with some other countries (like NL) and the relaxation of rules on what documents shall be accepted in the event of a tax inspection shall be considered; ➡️Whether and in what circumstances teleworking can generate a permanent establishment (PE): we do not want to live in a world with ‘’micro-PEs’’, balancing between a very limited profit vs a huge administrative burden to the state.
