Throughout his tenure as President of New York State Trial Lawyers Association, Partner David Scher has continuously advocated for the passage of the Grieving Families Act. Yesterday, he spoke to Spectrum News to express support for the latest iteration of the bill. “The Grieving Families Act recognizes the changes the governor called for and is ready for her signature, which will at long last bring New York into step with 48 other states,” said Scher. “Self-interested, profit-hungry insurers, who oppose this common sense reform, are raking in record profits at the expense of hardworking New Yorkers.” Read the full article here: https://lnkd.in/e8kjx5gG

The Grieving Families Act (GFA), reintroduced in May 2023 by New York lawmakers with notable revisions in response to Governor Hochul’s concerns, has again been vetoed by the Governor. The revised GFA was drafted to limit the class of plaintiffs entitled to recover damages, shorten the statute of limitations, and revise retroactivity clauses. Concerns about the expansive clause involving non-economic damages had been addressed by the New York Senate and Assembly, and although vetoed, the GFA continues to represent significant changes on the horizon for plaintiffs and defendants in wrongful death actions. We will continue to monitor the bill’s progress and future reintroduction by New York’s legislature. SSA acronyms can seem like a different language, but understanding them is crucial for navigating disability claims. Here are a few you should know: AUSA: Assistant United States Attorney. This attorney negotiates and interacts with the assistant US Attorney in Federal Court for SSA-related cases. BHA: Bureau of Hearings and Appeals (now ODAR). This office handles appeals before an Administrative Law Judge. BO: Branch Office. A local SSA office where you can access services. BWO: Blind Work Expenses. These are deductible expenses related to work for those who are blind, helping them meet SSA income thresholds. Understanding these acronyms can make the SSA process clearer. https://lnkd.in/dxyx3GKh #SocialSecurityLawGroup #SSA #DisabilityClaims #SSAAcronyms

The tragic murder of Sonya Massey by Deputy Sean Grayson, after she called 911 for help, has starkly highlighted a painful reality. For many women experiencing domestic violence and sexual assault or a mental health crisis, engaging with law enforcement is fraught with fear and skepticism. When the intersection of race and gender is present the fear can be even more present. Sonya Massey’s death is a devastating example of why these women often hesitate to seek protection from their abusers or help when in crisis. Advocates have long heard from survivors about their fears: not being believed, not being supported, not being protected, and even the possibility of experiencing additional harm from those sworn to protect them. Sonya Massey’s murder tragically confirms these fears, reinforcing the deep-seated mistrust many survivors have toward law enforcement. I know this does not reflect the actions of all law enforcement officers, I acknowledge that. Over the past 25 years, I have worked with many outstanding officers dedicated to their duty. However, we cannot ignore the profound impact of Sonya Massey’s murder and the validation it provides to survivors’ fears is a systemic issue that must be addressed. The mission of law enforcement is to protect and serve. But how can this mission be fulfilled when those who seek help may end up being killed? Sonya Massey’s death demands a thorough examination of how law enforcement interacts with vulnerable communities and a commitment to meaningful change to ensure that every call for help is met with safety, respect, and compassion. Sonya’s death must be a catalyst for systemic reform. Law enforcement agencies must prioritize training in trauma-informed care and cultural competence, emphasizing the importance of understanding and addressing the unique challenges faced by marginalized communities. Furthermore, there must be accountability and transparency in handling such tragic incidents, ensuring justice for victims and rebuilding trust within the communities they serve. In memory of Sonya Massey, we must advocate for a future where every individual and survivor feel safe to seek help without fear of harm, where protection and justice are accessible to all, regardless of race or background. Let her death not be in vain but a powerful call to action for creating a more just and equitable society. Teresa M.
