Last month, Parole and Probation Agent Davis Martinez was tragically killed on duty. AFSCME Local 3661 continues to demand better safety protocols, despite Maryland State Department of Public Safety repeatedly ignoring members' safety concerns. Martinez’s death is a wake-up call for protecting public safety workers.

Communities across the U.S. have increasingly turned to civilian oversight as an important component of public safety. State legislatures should respect the political processes undertaken by municipalities that choose civilian oversight, particularly where the choice has been made directly by voters. State legislation that is purportedly intended to bring uniformity to civilian oversight by limiting its scope and power is misguided. The whole point of civilian oversight is to allow each community to create the kind of community input to policing that meets that community’s specific needs. Today, there are many other more important, productive ways for state legislatures to show their support for law enforcement.

Does that still make common sense after the seventh staff member from FCI Dublin has been sentenced? Perhaps it is more accurate to state there is an unwillingness amongst agency leadership (e.g., Director, Deputy Director, Assistant Directors and Regional Directors) to effectively identify, choose, train, support and empower facility leaders to make local decisions to support quality staff and remove ineffective ones before they commit these egregious crimes? Continuous violations of policy, code of conduct and the law will persist until the agency shifts to a more modern, flexible and informed approach to selecting, promoting and removing their staff. Some people are a poor fit for corrections work and they should be assisted earlier in their careers to understand this fact and flourish elsewhere.

As conversations about the future of law enforcement evolve, so do legislative priorities. 🚔 In Florida, lawmakers passed H.B. 7051. Along with establishing standards associated with uses of force, it also mandated the instruction on alternatives to the use of force, including de-escalation training, be required to obtain initial certification as a police officer within the state. Illinois’ legislation is similar to Florida’s. H.B. 3653 requires that probationary officers be instructed on the use of de-escalation techniques.
