This Note examines the current legal framework governing the use of black box recording devices in automobiles. It sets forth the federal and state provisions governing black boxes and discusses the consumer legal concerns regarding notice, ownership, consent, and privacy, concluding that the federal guidelines fall short of necessary privacy safeguards. This Note examines the current legal framework governing the use of black box recording devices in automobiles. It sets forth the federal and state provisions governing black boxes and discusses the consumer legal concerns regarding notice, ownership, consent, and privacy, concluding that the federal guidelines fall short of necessary privacy safeguards. It also explores the potential Fourth Amendment implications of black box data collection from vehicles and its use by third parties as well as evidence in civil and criminal trials. Finally, this note reviews pending federal legislation that will solve some, but not all, of the issues created by the recording and collection of vehicle data and anticipates what Americans might expect from the future as the prevalence of recording devices increases.
