Earlier this year, Rajiv S. Khanna, managing attorney at Immigration.com, the Law Offices of Rajiv S. Khanna, PC had forecasted that there would be a second round of H1B visa lottery.

Speaking to Mint, Khanna had said, The IT industry has faced layoffs, and some employers are hesitant to commit to hiring foreign workers. This uncertainty has led to delays in the filing of H1B visa applications, with some employers waited to see how the market evolves before submitting their applications.

How the second round of the lottery is decided?
The government statistically computes the number of applicants that would be needed to fulfill the visa allotment that they have and typically selects more applicants than the available number of visas to account for those who do not end up filing for various reasons. “If the computations, which are only statistical projections, are incorrect and there are leftover visas, a second round of the lottery may be held to allocate the remaining visas, Khanna had said.

Can I hire people while still maintaining my H-1B with my current employer? Since I registered the company What is my status now? H-1 or EAD. My friend is a GC. Can I be a partner to start a new company and hire people?

Answer: When you are a derivative applicant for a green card, you are permitted to start your own business. I see no problem with that. You can also hire other people for your company. But there appears to be a basic confusion in your question. Once you start using your employment authorization, you are no longer on H-1B status.

You can also be a partner in another company if you so wish, but your H--1B status would then become inactive and you would be using your employment authorization. That, of course, it's perfectly legal. Note that merely registering a company without doing any business or business activity does not violate your H-1B status in my opinion.

Answer: If you are outside the US for more than one year, under normal circumstances, your green card is presumed to be abandoned. Any continuous stay outside for more than six months subjects you to a higher degree of scrutiny. Ideally, your stay outside should be less than six months and your permanent residence should (such as the location of the office you report to) remain in the US. The facts and recommended courses for each case are different. Because a green card is a valuable benefit, I recommend you discuss your case with competent counsel.

    My comments in the news:
Rajiv S. Khanna states that last month, the US Customs and Border Protection (CBP) issued a reminder to the airlines to let people board as long as the green card date has not expired. Any queries regarding boarding can be directed to the concerned CBP officials and the passenger can be allowed to board.
“I anticipate that a judgement about the status of their green card (if the stay outside the US is over a year) will be made in what is referred to as ‘secondary inspection at a US port of entry. CBP is likely to take into account the involuntary nature of absence from the US,” explains Khanna.

Rajiv S Khanna, Managing Attorney at Immigration.com told TOI, "The May 14, timeline should take us past the H-1B lottery, if the Labour Condition Application (LCA) process is done before the kick-off date." The registration for H-1B applications (petitions) for the coming season is expected to commence in March. The lottery will be held in April.

    The Economic Times

Multiple filings are permitted if they are from different fiscal years. For instance, there are instances where petitions from the past fiscal year are still pending in the current year. In such cases, it does not appear that there is any prohibition against filing again for the same employee. An employer would be well within their rights to try for an H-1B lottery selection again.

Biden’s administration will do what is good for the USA. That is to be expected. It is obvious that the administration is inclined to take a hard look at the possible loopholes in the system that may be causing problems such as suppression of wages.

    The Economic Times

Until 2019, when a decision from the Department of Labor (DOL) changed the calculus, our answer to this question was: “An H-1B employee may work from outside the USA and be paid under any terms, not necessarily those required by the H-1B laws.”

Two developments in immigration law bring happy tidings: a court challenge to OPT and STEM OPT extension has failed; and the US Department of Labor (DOL) has delayed to May 14, 2021 (beyond the H-1B lottery deadlines) implementation of the regulations affecting disproportionate wage hikes for H-1B and green card petitions.

Politically, this is a good time for immigration laws to be revamped and modernized. Democrats, that is Biden’s party, have the majority (although a slim one) to pass laws & be effective.

The substantive defects in the rule, however, remain open to serious question and the rule is likely to be stayed and reversed by courts.

You are very likely, perhaps even certain to run into immigration issues if you are: an in-house counsel, a university/education lawyer, an M&A/corporate lawyer, a litigator, a labor/employment lawyer, a business lawyer or general practitioner/contracts lawyer including government contracts lawyer, or part of a business/management team or HR of an organization. The purpose of this article is to sensitize you and alert you to some of the more precarious issues that we see in our practice.
