The U.S. Attorney’s Office for the Southern District of Texas announced on August 20 that National Interventional Radiology Partners PLLC (NIRP) and its founder and CEO will pay $8,884,091 to the United States to resolve alleged violations of the federal False Claims Act (FCA) and Anti-Kickback Statute. NIRP and Dr. Andrew Gomes allegedly illegally paid physicians for referrals to treat patients with peripheral arterial disease (PAD), which usually affects the lower legs of elderly people. Gregory Miller and Timothy Gonzalez succeeded in getting the Centers for Medicare and Medicaid Services (CMS) to stop suspending payments to the firm’s client, a clinical laboratory. In 2022, the client had its Medicare and Medicaid billing privileges suspended due to allegations of fraud. The client's previous counsel failed to defend against these claims, leading to an extended suspension by CMS. In 2023, Greg and Tim were asked to review and respond to the allegations. They conducted a thorough evaluation of the client’s procedures and claims data and developed an innovative strategy to prove the legitimacy of the client’s work. That strategy centered on a comprehensive written submission and extensive evidence proving that CMS' fraud allegations were baseless and the suspension unwarranted. Greg and Tim also targeted their outreach to key individuals at CMS and the Department of Health and Human Services (HHS) to ensure their submission was received and reviewed by decision makers. Despite numerous procedural and bureaucratic challenges, Greg and Tim secured a meeting with critical stakeholders both at CMS and HHS, where they successfully demonstrated the services provided by the client were bona fide, and no fraud occurred. The Office of the New York State Attorney General announced on August 13 that Letitia James, along with the Attorneys General of Connecticut and New Jersey, fined Enzo Biochem, Inc. $4.5 million for failing to adequately safeguard its patients’ health data. Enzo conducts drug research and development, and provides diagnostic services. In 2023, hackers accessed Enzo’s networks using two employee login credentials. The credentials were shared among five Enzo employees and one set of credentials had not been changed for 10 years. The hackers installed malicious software on Enzo’s systems, stealing files and data concerning 2.4 million patients, including names, addresses, birth dates, phone numbers, social security numbers, and health information.
