The U.S. Supreme Court during its last term handed Donald Trump victories in three major cases. But those may not be the last of the former president's legal entanglements that the court is asked to decide. Seven important cases featuring Trump as the defendant are currently in the lower courts — two involving federal criminal charges, two state criminal prosecutions and three civil lawsuits. These eventually could be appealed to the Supreme Court, though it is not likely to hear any of them during its new nine-month term that began Oct. 7. And this does not count the potential for litigation over voting results in the Nov. 5 U.S. election. Trump is the Republican candidate facing Democratic Vice President Kamala Harris, with the winner becoming president on Jan. 20. The fate of at least two of the cases with Trump as a defendant could hinge on the election's outcome. Read more: https://lnkd.in/gv8WUY2k #trump #legal #scotus

A former federal judge in Alaska who resigned amid a misconduct scandal texted with a clerk-turned-prosecutor with whom he had an inappropriate relationship about an ongoing criminal trial in his court that she attended, according to the defendant's lawyer. Details about former U.S. District Judge Joshua Kindred's texts emerged in a filing on Oct. 9 with the 9th Circuit by the lawyer representing former nurse practitioner Jessica Spayd whose trial Kindred was presiding over when he sent the messages. Public defender Michael Marks is seeking to put Spayd's appeal on hold so she can pursue a motion for a new trial. Kindred sentenced Spayd to 30 years in prison for illegally prescribing millions of opioids while operating a pain clinic, resulting in five overdose deaths. Sean ‘Diddy’ Combs will stand trial on federal sex trafficking and racketeering charges starting on May 5, a U.S. judge decided during a hearing, and the jailed hip-hop mogul blew kisses to his family in the courtroom afterward. During the hearing before U.S. District Judge Arun Subramanian in Manhattan federal court, Combs' lawyer Marc Agnifilo also raised concerns about what he termed improper leaks by federal agents about the case. Prosecutor Emily Johnson called the claim baseless. Combs pleaded not guilty on Sept. 17 to a three-count indictment charging him with using his business empire — including record label Bad Boy Entertainment — to transport women and male sex workers across state lines to take part in recorded sexual performances called ‘Freak Offs.’ Today’s hearing marked a third court appearance for Combs since his September arrest. Twenty Republican state attorneys general have sued the Biden administration over a new federal rule on minimum staffing for nursing homes, saying it will drive nursing homes out of business. The rule, announced in April by the U.S. Department of Health and Human Services, would require nursing homes to have a registered nurse on duty 24 hours per day, and total nurse staffing of at least 3-1/2 hours per resident per day. Federal law previously required nursing homes to employ a registered nurse for eight consecutive hours per day. The plaintiffs said HHS had been arbitrary and capricious in passing the rule without adequately considering nationwide nursing staff shortages. A group of FTX investors told a Miami federal court on Oct. 9 that they are voluntarily dismissing their proposed class action against prominent U.S. law firm Sullivan & Cromwell. The investors had accused Sullivan & Cromwell of participating in the defunct cryptocurrency exchange's multibillion-dollar fraud and then enriching itself as FTX's lead bankruptcy counsel. The firm had represented FTX on about 20 matters before it collapsed. But lead plaintiffs' counsel Adam Moskowitz told Reuters that there was 'no claim at this stage' against the New York-founded law firm. TD Bank became the largest bank in U.S. history to plead guilty to violating a federal law aimed at preventing money laundering, and agreed to pay $3 billion in penalties to resolve the charges, government authorities said. TD's plea deal includes imposition of an asset cap and other limitations to its business, authorities said. The bank has pleaded guilty to conspiring to launder money and conspiring to fail to file accurate reports or maintain a compliant anti-money laundering program, the Justice Department said. WilmerHale’s Seth Waxman urged #scotus to throw out Oklahoma death row inmate Richard Glossip’s conviction for a 1997 murder-for-hire based on his claim that prosecutors wrongly withheld evidence that could help his defense. Justice Ketanji Brown Jackson suggested that at a minimum the justices could send the case back to a lower court to evaluate whether the newly disclosed information favors Glossip's defense. Oklahoma's attorney general is supporting Glossip's appeal. Subscribe to The Daily Docket: https://reut.rs/4dsTnQ1 #legal #legalnews #litigation

The lead negotiator for a #Boeing union representing about 33,000 workers who have been on strike for nearly a month said on Oct. 9 that members were prepared to wait out the planemaker, after pay talks collapsed a day earlier.   'We're in this for the long haul and our members understand that,' Jon Holden said in an interview with Reuters.   He said Boeing offered only minor improvements before breaking off talks on Oct. 8 and the union had a strong fund to support paying members $250 a week during the stoppage.   Boeing said on Oct. 8 it had withdrawn its pay offer to the #union after two days of talks and accused it of not seriously considering its proposals.   Read more: https://lnkd.in/d2Dj3qJK #legal #labor
