Punitive Damages in Arbitration! Last week Cal Harris and I finalized an arbitration which resulted in an combined award for our clients of $833,235, including $55,000 in punitive damages and a full award of our firm's attorney's fees. It also included a declaration that the promissory note, guaranty, and employment contract were void. Thus, saving our clients hundreds of thousands in additional money. Our clients bought a business in Canton and were defrauded by the seller and the non-owning spouse of the seller (a medical doctor). The case was hard fought with good lawyers on the other side and tried over 3 days. Among other complexities, it required us to go to Superior Court and obtain an order of contempt against a non-compliance witness and undergo personal threats from witnesses and relatives before it was finalized. We never back down when our clients have been defrauded.

The Supreme Court of Georgia issued a ruling clarifying how the state's Open Records Act applies to private contractors. Cross Kincaid co-founders Anna Green Cross and Meredith Kincaid teamed with Poole Huffman, LLC trial attorney Lucas Andrews to represent appellant Ryan Milliron. For the appellee were Venable LLP attorneys Theodore Randles and Mark Schamel of Washington, D.C. Justice Shawn Ellen LaGrua wrote the decision for the court. $9M Racketeering Verdict Late last Thursday, Jon David Huffman and Timothy Andrews of Poole Huffman, LLC successfully secured a jury verdict for $9M, including treble damages for racketeering. Their client’s racketeering claim was based on predicate acts of wire fraud, securities fraud, and theft. Additional counts included conspiracy to defraud, conspiracy to commit securities fraud, and breach of fiduciary duty. After a 9-day trial in the Fulton County Business Court, their client (who was ironically the Defendant) was finally vindicated. In his closing, Mr. Huffman argued that Galaxy Next Generation, Inc. (a publicly traded company) and their CEO and CFO were frauds, liars, and criminals. Mr. Huffman also argued that Galaxy was a Ponzi scheme, having no legitimate business other than to raise money from public markets. Poole Huffman’s client was the mark needed to continue their scheme. Evidently, the jury agreed.
