Signed July 24, H.B. 179 will impact the filing of civil lawsuits in two ways: 1) the tolling period for an absconded defendant will not apply to the statute of repose, and 2) a plaintiff need not name an individual in order to assert respondeat superior liability against an employer except in limited circumstances. In a recently closed case, the Insured was accused of revising documents while the client was in hospice and without capacity. Next in our continuing series on recently closed claims, a client sustained work-related injuries during a collision with a State-operated truck. Despite a couple years of litigation, the court’s determination of damages occurred after the client’s death. The court did not consider future damages in light of the facts. The estate alleged that the Insured should have insisted on a prior, larger settlement offer that was made prior to the client’s passing rather than the smaller award from the court. Attention estate administrators! The Ohio’s Medicaid Estate Recovery program requires repayment for Medicaid benefits, with all assets subject to recovery. Administrators must submit a “Notice to Administrator of Medicaid Estate Recovery Program” within 30 days of receiving letters, and the state has 90 days to make a claim. OBLIC recommends holding distribution of assets until after the recovery period.
