For our clients lending in New York, two recent bills have been passed that impact the mortgage tax imposed in the counties of Chenango and Otsego. New York Senate Bill 5780A and New York Senate Bill 4289A[1](the “Bills”) amend Article 11 of NY Tax Law (Tax on Mortgages), which provides, among other things, authority for various counties in New York to impose additional mortgage recording tax. A summary of the Bills is as follows: · the Bills were passed on September 27, 2024; · the Bills amend Article 11 of NY Tax Law by adding § 253-z to allow the Counties of Chenango and Otsego to impose an additional mortgage recording tax of 25 cents per $100 of principal debt or obligation; and · the amendment to NY Tax Law for the County of Otsego is effective as of September 27, 2024, however, the amendment for the County of Chenango is effective as of November 26, 2024. Lenders in New York should carefully review the local county and state rules to ensure that mortgage recording tax is correctly calculated and remitted to the County Clerk’s Office. A delay in recording a mortgage could pose a risk to a lender’s lien priority, which will be critical in the event of a future default of the mortgage loan.
