    Moore & Van Allen PLLC (MVA) is pleased to announce that Member Holly Bannerman was named to the 2024 Lawdragon 500 Leading Global Real Estate Lawyers list. This list, the newest guide in Lawdragon’s collection, recognizes outstanding lawyers who practice in all realms of real estate law, from land use and leasing to financing and construction. Lawdragon editor Katrina Dewey remarked that their examination of the candidates for this inaugural guide “brought enormous respect for the depth of knowledge in the law and local business and politics required for any great real estate lawyer.” The list is 20% female and 15% inclusive. Bannerman practices on the firm’s Commercial Real Estate team, representing developers, owners, landlords, tenants and limited partners in a variety of real estate transactions, including land acquisitions, dispositions, financing, development and leasing. She also specializes in joint venture and limited partnership agreements and the related structuring of real estate transactions. Bannerman has experience representing developers and sponsors in all aspects of a new development, from raising equity and negotiating joint venture agreements (at the individual investor and preferred equity levels) to land acquisition and financing to leasing and/or disposition.     Moore & Van Allen (MVA), Financial Regulatory Advice and Response Member, Kate Wellman authored the article, “FDIC final resolution planning rule increases requirements on large insured depository institutions”, which was published by Reuters and Westlaw Today on August 12. The article On June 20, 2024, the Federal Deposit Insurance Corporation (FDIC) issued a final rule (Final Rule) which will significantly increase the resolution planning requirements under 12 CFR § 360.10 on covered insured depository institutions with $50 billion or more in total assets (CIDIs). The Final Rule responds to the FDIC's experience in the 2023 bank failures and is largely unchanged from the FDIC's September 2023 proposal (Proposed Rule), with limited revisions to the frequency and required content of submissions. The few changes and FDIC's responses to comments received on the Proposed Rule indicate it is preserving the flexibility to further develop its resolution planning expectations based on its review of submissions beginning in 2025 and engagement with CIDIs. https://lnkd.in/e2ck3uEn

    Moore & Van Allen (MVA) Litigation Associate Pierce Werner, Head of Environmental Mary Katherine Stukes, and Litigation Associate Chassity Bobbitt co-authored the article, “'The court giveth, and the court taketh away': the epitaph of the Chevron doctrine” which was published by Reuters and Westlaw Today on August 8. The article Forty years ago, legal conservatives lauded a decision by the Supreme Court upholding an interpretation of the federal Clean Air Act by then-President Reagan's Environmental Protection Agency that significantly eased regulation of air emissions from "stationary sources." The Court articulated what seemed at the time to be an uncontroversial legal principle: When Congress has given an agency authority to administer a statute, in cases of ambiguity or silence, courts should presume that Congress implicitly delegated a limited interpretive authority to the agency to act within that delegation to fill in the gaps reasonably permitted by the statutory text. https://lnkd.in/eU-UQXWv
