At its initial meeting, FDA's new advisory committee on digital health is set to examine its approach for evaluating and regulating the safety and effectiveness of medical devices utilizing GenAI. The committee will receive stakeholder insight regarding premarket performance evaluation, risk management, and postmarket performance monitoring. The Hague Court of Appeals has overturned the landmark climate change litigation case that imposed a CO2 reduction obligation on Shell. The ruling also confirmed the duty of companies to reduce CO2 emissions. While a specific reduction target cannot be imposed by the civil courts, companies with a presence in the Netherlands that fail to implement adequate reduction measures may be subject to future litigation. California recently enacted new mandatory disclosure requirements related to social compliance audits. Beginning January 1, 2025, if an employer chooses to audit its compliance with child labor laws, the employer must publicly report the results of that audit on its website. The UK Government has given organizations nine months to “get their house in order” and put in place reasonable fraud prevention procedures before the entry into force of the UK’s new “failure to prevent fraud” offence in September 2025. Large organizations selling goods and services to UK-based customers are at risk of being prosecuted for the new failure-to-prevent-fraud offense, whether they have a physical presence in the UK or not. On May 22, 2024, the NIH announced that it is seeking public input on the development and implementation of a new policy to promote patient access to products stemming from NIH-owned inventions. This request for comments is part of ongoing efforts to improve patient access to vaccines, drugs, biologics, and medical devices to patients in the United States and abroad, who may otherwise lack access to such products due to a number of factors, including high costs.
