In Marin Audubon v FAA, two of the three judges questioned the Council of Environmental Quality’s (CEQ) authority to issue regulations, despite that it was unnecessary to the court’s holding. For Holland & Hart #NEPA attorneys, that court’s commentary is dicta, and the immediate impact may not significantly affect other federal agencies or the regulated community’s ongoing NEPA compliance obligations.
