The U.S. has finalized a new regulatory program governing investments by U.S. persons in PRC-related companies involved in three technology sectors of national security concern—semiconductors and microelectronics, quantum information technologies and artificial intelligence systems. This new program will in some cases require post-closing reporting and in other cases outright prohibit investments by U.S. persons in companies in these three technology sectors. Excited to be back in Philly to teach the second half of the Startups & Venture Capital Bootcamp with Elizabeth Pollman at the University of Pennsylvania Carey Law School. The first half was very engaging as we took a great group of students through the startup formation process and then through seed and venture financing. On August 1, 2024, the landmark comprehensive artificial intelligence (“AI”) law – the European Union Artificial Intelligence Act (the “EU AI Act” or the “Act”) – entered into force. While most obligations under the Act will not become effective until August 2026, AI systems deemed to pose “unacceptable risk” will be prohibited starting February 2, 2025, and certain obligations, including those for providers of general-purpose AI models, will go into effect August 2, 2025.
