A recent Ninth Circuit decision clarifies employers’ obligations to address hostile work environment complaints arising out of employees' off-premises social media activity. In Okonowsky v. Garland (No. 23-55404; Jul. 25, 2024), the Ninth Circuit reversed summary judgment against a Title VII sexually hostile environment action, finding that the court had erred by considering only some of the evidence and by applying incorrect legal standards. Emphasizing the ubiquitous nature of social media and its impact on the workplace, the Ninth Circuit’s decision provides guidance for employer best practices in investigating and responding to employee complaints arising out of off-duty social media use. As patent practitioners know, Daubert motions can be some of the most hotly contested and pivotal motions in the life of a patent case. These motions are used to exclude testimony from an opponent's expert witness, usually on the grounds that the expert's opinion is unreliable or methodologically defective. A successful (or even partially successful) Daubert motion can drive settlement and significantly affect the course of trial. In late 2023, the evidentiary rule governing expert testimony — Federal Rule of Evidence 702 — was revised for the first time in nearly 25 years. The new Rule 702 has now been in effect for just over six months. We reviewed how courts have been applying the new Rule 702 in this six-month period, particularly in busy patent-litigation venues including the District of Delaware, the Eastern District of Texas, and the Western District of Texas. Let's take a look at what we've learned in these first six months and what practical takeaways there are for patent litigators. Coming out of their recent rulemaking meeting, the California Privacy Protection Agency is not surprisingly finding the question of how to regulate the use of ADMT to be a difficult one. While pointing to consumer interest in requiring significant oversight and assessment, the Agency at the same time must grapple with the fact that such assessment could be debilitatingly expensive for many companies.
