Each year, the Consumer Financial Protection Bureau (CFPB) publishes a Consumer Response Annual Report as part of the Consumer Financial Protection Act of 2010. This report outlines and analyzes data about complaints in the financial industry, including complaints sent by customers. In March 2024, the CFPB published the Consumer Response Annual Report. The information in this report includes data from January 1 to December 31, 2023. INFiN, A Financial Services Alliance, is a financial organization that many financial institutions are a part of. It works to bring together finance companies who have a common goal of providing trustworthy, reputable, and safe financial services to customers everywhere. On December 14, 2023, INFiN, a Financial Services Alliance, responded to a proposal made by Senator Jack Reed to implement a national Annual Percentage Rate (APR) cap on consumer credit. This proposal would have a significant impact on consumers in the financial industry. As a representative of over 350 financial companies, INFin made a statement to address this proposal. INFiN expressed concerns regarding the senator’s proposal and voiced particular concern over the way this proposal would limit consumer access to regulated credit options, ultimately affecting hardworking individuals who rely on these services. A new House Bill recently went into effect in New Mexico that capped the maximum rates lenders could apply to loans up to $10,000. After this bill took effect, the New Mexico Regulation and Licensing Department (NMRLD) collected data about the impact this bill had on lending businesses in New Mexico. This data was then analyzed by the Online Lenders Alliance (OLA), showing that this bill had a large impact on small loan businesses and consumers. Overall the OLA then found that this new data from New Mexico indicates that rate caps lower consumer credit options considerably.
