FTC NON-COMPETE BAN UPDATE: Today, the Pennsylvania judge overseeing the tree service company case challenging the FTC’s Non-Compete Clause Rule denied the company’s attempt to enjoin the Rule’s effective date, which is set to take effect in early September. This is the second judge to have ruled on challengers’ efforts to stop the Rule from taking effect. However, contrary to Judge Brown’s findings in the Texas case earlier this month, Judge Hodge concluded the challengers failed to establish that they will suffer irreparable harm if the Rule were to take effect, and that the challengers did not establish a reasonable chance or probability of winning on their claims. Regarding the latter, Judge Hodge found it to be “clear” that “the FTC is empowered to make both procedural and substantive rules as is necessary to prevent unfair methods of competition.” This conclusion is opposite of the Texas judge’s finding on the same issue. Stay tuned. A third proceeding in Florida is being teed up. And Judge Brown is expected to issue a final decision on the merits in the Texas case by the end of August.
