He provides recs for #AI companies: 1) Give users tools to voluntarily share chat logs directly w/ researchers. 2) Use transparency reports to share aggregate info ab how people use their products. 3) Explore privacy preserving ways to share anonymized chat logs w/ researchers. 📢 Last Monday, CDT hosted a symposium on #AI & The First Amendment with The Future of Free Speech. Government officials, civil society, & academics discussed the importance of speech considerations in AI regulatory debates. Panel 1: Moderated by CDT’s Samir Jain, it included bipartisan congressional staff who discussed balancing constitutional rights, #Section230's application to #AI, and new legislation. Panel 2: CDT’s Becca Branum moderated a discussion on the First Amendment & #AI. Discussion focused heavily on #Section230’s impact in the AI era, with Eugene Volokh calling the statute a "sword and shield" for #ContentModeration. Panel 3: The Future of Free Speech's CEO Jacob Mchangama, described the balance between free speech & safety as “fuzzy,” impacting information access & traditional speech. Despite challenges, panelists remain optimistic about AI's future, emphasizing careful regulatory and technical considerations. Panel 4: In the final panel, CDT’s Kate Ruane emphasized civil society’s vital role in #AI regulation & in bringing users’ perspectives to the table. Joined by Knight First Amendment Institute at Columbia University's Nadine F. Johnson and Stand Together's Ashkhen Kazaryan, they discussed how civil society shapes change through accountability, expertise, and influence. 🚨 Breaking News: In a 9-0 decision in #NetChoice v. Moody & NetChoice v. Paxton, #SCOTUS sent the Texas & Florida social media laws back to the lower courts, but Justice Kagan’s majority opinion is a win for free expression 👇 The opinion signals that the gov’t likely cannot dictate #ContentModeration decisions in the way the states sought. In its opinion, the Court reified 3 long-standing #1A principles to guide the lower courts in their future analysis of the TX and FL laws: 1️⃣ 1A protects entities when they compile & curate others’ speech for publication. 2️⃣This doesn't change b/c a publisher only excludes a small % of speech. 3️⃣ Gov’t cannot sustain its law by asserting an interest in balancing the marketplace of ideas. The Court went further, specifically noting that Texas likely cannot succeed in enforcing its law against content moderation in platforms’ main news feed. These are positive signs for analysis of these statutes going forward. But the Court did not answer every question about the constitutionality of these statutes or future laws that might regulate social media services and appears to have left room for regulation, particularly where the regulation does not apply to an “expressive product.” 📢💻 CDT experts, including FX Director Kate Ruane and VP of Policy Samir Jain will be analyzing implications of this ruling today. 🚨 Since the #Dobbs decision, states have taken diverse approaches to protect abortion access & shield healthcare data. CDT’s Jake Laperruque & Interns Irene Kim & Divya Vatsa authored a report reviewing state initiatives impact on healthcare privacy. Some states have enacted "shield laws" to safeguard providers & patients from out-of-state investigations into reproductive health services. These laws aim to prevent disclosures of sensitive information like private online messages related to abortion. 🛡️ Our analysis covers 22 states identified by Guttmacher as having protections for abortion services. It reviews measures aimed at safeguarding reproductive health information amidst increasing legislative challenges.
