Arnold & Porter’s women partners and counsel recently took part in a rewarding team-building activity with Impact 4 Good, where they built and donated drones to benefit STEM for Her. The event was a part of the two-day summit organized by Arnold & Porter’s women’s affinity group WISE (Women’s Initiative for Success and Empowerment). Through this hands-on experience, our women leaders came together to collaborate in support of STEM for Her’s mission to inspire young women to pursue STEM careers. For the past few years, we at Qui Notes have closely monitored court decisions on the “resulting from” requirement for claims under the Anti-Kickback Statute (AKS). Notably, the Eighth Circuit’s decision in U.S. ex rel. Cairns v. D.S. Med. LLC and the Sixth Circuit’s decision in U.S. ex rel. Martin v. Hathaway have emphasized the need for “but-for” causation to establish liability. Recently, in U.S. ex rel. Louderback v. Sumitomo Pharma Am., Inc., a Minnesota district court dismissed a relator’s claim for failing to meet this causation standard, highlighting the significant impact of this requirement. This decision follows a previous dismissal in 2023, where the court rejected the argument that all claims were false due to AKS violations, despite support from the Department of Justice.
