ABOUT THE AUTHOR Pierre Wolmarans obtained a B Proc degree at the University of Pretoria, an Advanced Diploma in Employment Law at the University of Johannesburg and a LLM degree at the Nelson Mandela Metropolitan University (previously the University of Port Elizabeth), all in South Africa. Pierre has been involved in the legal field in many different capacities for some 35 years, is still practicing as a Commercial and Employment Law Specialist and as such retained by various multinational and South African businesses. Pierre is often quoted in the South African Press and regularly interviewed on Radio newscasts in relation to his expertise on Employment Law. Pierre authored many Commercial and Employment Law related articles and is a popular speaker at seminars. Pierre is married to Annemarie and has three sons - Armand, Jadon and Don.

    Although it might be lost on foreigners, the title of this little book about ‘the legal fraternity’s shenanigans’ encouraged me to have high expectations of its contents – could Pierre Wolmarans be South Africa’s very own John Mortimer [the British barrister who created Rumpole of the Bailey]? The answer is an unequivocal no. Mr. Wolmarans has qualifications from the Universities of Pretoria and Port Elizabeth, and apparently his legal opinions are often sought by the media. It’s a fair bet though no one has ever asked him how to tell a funny story and this collection of true tales of ‘legal humour’ completely fails to amuse.

BACKGROUND

I am very fortunate to have been exposed through many years to interesting, sometimes tedious albeit often humorous situations during my involvement in and with various legal firms, consultancies, colleagues, clients, tribunals, courts of law, Arbitrators, Commissioners and Judges.

I have completed B Proc and LLM degrees as well as an Advanced Diploma in Employment Law at three different South African Universities.

One of the wonderful aspects of the law, especially at tribunals or in courts, is that almost anything that may be relevant to the matter at hand will mostly be forced into the clear elevated reality of the truth. The sometimes unforgiving and relentless approach by practitioners of the law and presiding officials often lead to unpredictable and indeed humorous reactions by litigants, witnesses and even the practitioners and presiding officials themselves.

Reading about some of the legal fraternity’s shenanigans seemingly confirms that ‘the law is an ass’.

The chapters in this book each consists of independent short and interesting versions of strange, often unexpected, humorous behavior and reactions; be it intended or not, by law Professors, junior and senior lawyers, clients and Judges in and out of courts.

Some of the versions are rather real containing profanities which were indeed so used and have not been watered down in any way to soften the weight thereof on your ear. Therein often rests the laugh. Limited poetic license was used in many instances.

Some of the versions contain explanations of certain applicable processes to bring the full impact of the shenanigan to bear.

I was personally present in relation to chapters 1, 2 and 3 and the contents of chapter 4 were conveyed to me by clients.

I represented the clients in relation to chapters 5, 6 and 7 and the rest of the chapters were relayed to me by colleagues. The versions relayed by my colleagues may have been amended over the years as some of them have probably been elevated to the status of urban legends.

My intention with this book is for you, the reader, to—Enjoy and hopefully have a laugh or at least a good chuckle.

WAGON OF GOLD

AND THE NAAIMASJIEN

Many years ago in the late seventies whilst I was a young candidate attorney in Pretoria, South Africa, or as it was referred during those days an article clerk, the unopposed divorce cases were heard every week on Wednesdays.

The alphabetical court roll listing the names of the divorcing parties was always split between two courts given the high number of either unopposed or settled divorce cases enrolled on a weekly basis. Even in those days the court rolls often ran way in excess of one hundred unopposed divorce cases set down for every Wednesday.

The procedure on the day would be for the divorcing plaintiffs to arrive at the firm’s office at 8 am where their various attorneys would explain the process to be followed in court to each of their clients individually. Once each of the clients has been seen by their attorneys they would wait in the reception area until the whole group of divorcing plaintiffs was gathered in reception.

These plaintiffs would then be ready to be escorted to the advocates’ chambers where they would once again be prepared for what lies ahead. The exact questions to be repeated later in court would
