Kecenderungan untuk senantiasa mancapai jalan rekonsiliasi yang aman antara hukum adat dan hukum Islam mendorong kepada suatu situasi dalam masyarakat Indonesia di mana dua sistem hukum saling memberikan pengaruh satu sama lainnya. sekedar contoh saja dalam szuhat thalaq, di mana bolehnya si isteri untuk mengambil inisiatif dalam kasus tersebut, maka dapatlah dil:atakan bahw, - hukum Islam telah mengadaptasikan dirinia kepada hukum adat. Contoh di atas adalah suatu bukti bahwa di antara hukum adat dan hukum Islam terdapat perbedaan-perbedaan namun bukan berarti tertutup bagi terjadinva suatu rekonsiliasi. In Al-Quran (Koran), polygamy mention in Qs an-Nisa (4)’ verses 3, verses 20 and verses 129. Refer to an-Nisa’ (4) verses 3, literally give permitted for men to have four wive. This article usually use as a basic theology argument for them that agree with polygamy, but thi article means there are correlation between commandments to take care of orphan by let them married more than one wife. The commentator (on the Koran) agree with nuzul asbab (history) of these verses because wali (male relative legally responsible) not fair to the orphan under there protected. Noticing prophet marital not because of sexsual desire but only for religious proselytizing, education to struggle and to solve social and human problem. The Legislation Number 1/1974 about Marriage principally monogamy, even though arrange about polygamy but husband has to fulfil the requirements (1) when wife can’t do her responsibility as a wife (2) wife handicap or gets ill that can’t recover or can’t has the baby. Application from husband who wants to do polygamy send to court and he has to fulfil the requirements (1) has permission from his wife (2) husband can guarantee that he can earn his family (his wife and children). (3) husband has to fair to his wife and children. After examine the rule found it that, the rule still put wife in a lower position than husband and not give optimal protection for women. The Al Quran, Qs an-Nisa [4], want to examine about polygamy and find reference as an argument from Islamic point of view and the arrangement in legislation Number 1/1974 about Marriage.
