Truth and reconciliation commission

A truth commission or truth and reconciliation commission is a commission tasked with discovering and revealing past wrongdoing by a government (or, depending on the circumstances, non-state actors also), in the hope of resolving conflict left over from the past. They are, under various names, occasionally set up by states emerging from periods of internal unrest, civil war, or dictatorship.

As government reports, they can provide proof against historical revisionism of state terrorism and other crimes and human rights abuses. Truth commissions are sometimes criticised for allowing crimes to go unpunished, and creating impunity for serious human rights abusers. Their roles and abilities in this respect depend on their mandates, which vary widely.

One of the difficult issues that has arisen over the role of truth commissions in transitional societies, has centered on what should be the relationship between truth commissions and criminal prosecutions.

The first such commission was Argentina's National Commission on the Disappearance of Persons, created by President of Argentina Raúl Alfonsín on 15 December 1983. It issued the Nunca Más (Never Again) report, which documented human rights violations under the military dictatorship known as the National Reorganization Process. The report was delivered to Alfonsín on 20 September 1984 and opened the door to the Trial of the Juntas, the first major trial held for war crimes since the Nuremberg trials in Germany following World War II and the first to be conducted by a civilian court.

Truth and Reconciliation Commission (Liberia)

The Liberian Truth and Reconciliation Commission (TRC) is a Parliament-enacted organization created in May 2005 under the Transitional Government. The Commission worked throughout the first mandate of Ellen Johnson Sirleaf after her election as President of Liberia in November 2005. The Liberian TRC came to a conclusion in 2010, filing a final report and recommending relevant actions by national authorities to ensure responsibility and reparations.

The Liberian TRC has garnered much criticism for its inability to address Charles Taylor and Ellen Johnson Sirleaf. The Special Court for Sierra Leone indicted Charles Taylor, the leader of the rebel group the National Patriotic Front of Liberia that many of the crimes against humanity are attributed, the National Patriotic Front of Liberia, preventing the Liberian TRC from any testimony from Taylor. Sirleaf, on the other hand, was placed on a list of persons that should be barred from public office, a ruling which was later overturned by the Liberian Supreme Court.

Truth and Reconciliation Commission (Canada)

The Truth and Reconciliation Commission of Canada (TRC) was a truth and reconciliation commission organized by the parties to the Indian Residential Schools Settlement Agreement. The commission was part of a holistic and comprehensive response to the charges of abuse and other ill effects for First Nations children that resulted from the Indian residential school legacy. The Commission was officially established on June 2, 2008, and was completed in June 2015.

Background

The Aboriginal Men and Women, who lived through residential schools, placed the concern of residential schools on the public agenda.Their joint work resulted in the Indian Residential School Settlement Agreement, which stipulated a residential school Truth and Reconciliation Commission of Canada be conducted.The Royal commission concluded that the Canadian residential school system was established for the purpose of separating children from their families.According to the commission this was done with the intention to minimize the family's ability to pass along their cultural heritage to their children.And ideally allowing the residential schools to introduce the children to a Euro-Christian society. The commission spent six years travelling to different parts of Canada to hear the testimony of approximately six thousand Aboriginal people who as children were taken away from their families and placed in residential schools.
