F. D. Reeve

Franklin D'Olier "F.D." Reeve (September 18, 1928 - June 28, 2013) was an American academic, writer, poet, Russian translator, and editor. He was also the father of "Superman" actor Christopher Reeve. He was the grandson of the first American Legion national commander, Franklin D'Olier.

Life and career

Reeve was born in Philadelphia, the son of Anne Conrad D'Olier and Richard Henry Reeve. He was brought up outside New York City. Reeve worked in the wheat fields for a while during college and, after graduation, was a Hudson River longshoreman for a while. He graduated from Princeton University (1950) and Columbia University (1958), and in 1961 was one of the first exchanges between the American Council of Learned Societies and the USSR Academy of Sciences. In the late summer of 1962 he accompanied Robert Frost to Russia for his meeting with Nikita Khrushchev, where Reeve served as Frost's translator.

Reeve started his academic career teaching Russian language and literature at Columbia University. After teaching at Columbia, Reeve moved to Wesleyan University in 1962 as chairman of the Russian Department. In 1967, he joined Wesleyan's inter-disciplinary College of Letters where he taught literature, humanities and creative writing until his retirement in 2002. During the course of his career he had visiting appointments at Oxford University, Yale, and Columbia.

United States v. One Book Called Ulysses

United States v. One Book Called Ulysses was a 1933 case in the United States District Court for the Southern District of New York dealing with freedom of expression. At issue was whether James Joyce's novel Ulysses was obscene. In deciding it was not, Judge John M. Woolsey opened the door to importation and publication of serious works of literature that used coarse language or involved sexual subjects.

The trial court's decision was upheld by the United States Court of Appeals for the Second Circuit, which confirmed that offensive language in a literary work is not obscene where it does not promote lust. But Judge Woolsey's trial court opinion is now more widely known, and often cited as an erudite and discerning affirmation of literary free expression.

Background

In 1922 James Joyce published Ulysses, his most famous work. Prior to publication as a book, the work was serialized in The Little Review, a literary magazine. This periodical published the "Nausicäa episode," which contained a masturbation scene. Copies were mailed to potential subscribers; a girl of unknown age read it and was shocked, and a complaint was made to the Manhattan District Attorney. As the magazine could be purchased in a New York bookshop and The Little Review, the publisher, was based in the city, the local district attorney was able to prosecute in New York. Little Review publishers Margaret Caroline Anderson and Jane Heap could not argue that the chapter should be considered in light of the work as a whole, as only the offending chapter was published in the issue in question. The court convicted and fined Anderson and Heap after a trial in which one of the judges stated that the novel seemed "like the work of a disordered mind". That stopped publication of Ulysses in the United States for over a decade.

Glik v. Cunniffe

Glik v. Cunniffe, 655 F.3d 78 (1st Cir. 2011) was a case in which the United States Court of Appeals for the First Circuit held that a private citizen has the right to record video and audio of public officials in a public place, and that the arrest of the citizen for a wiretapping violation violated his First and Fourth Amendment rights. The case arose when Simon Glik, a private citizen, filmed Boston, Massachusetts police officers making an arrest in a public park. When the officers observed that Glik was recording the arrest, they arrested him and he was subsequently charged with wiretapping, disturbing the peace, and aiding in the escape of a prisoner. Glik then sued the City of Boston and the arresting officers, claiming that they violated his constitutional rights.

In a unanimous decision, the United States Court of Appeals for the First Circuit held that the officers violated Glik's constitutional rights and that the officers were not entitled to qualified immunity. The Court ruled that the right to film public officials in public places was "clearly established", and Glik's actions did not violate state law. However, the court also ruled that the right to film public officials was subject to reasonable limitations with respect to the time, place and manner in which the recording was conducted. After losing the appeal, Boston reached a settlement with Glik in which they agreed to pay him $170,000 in damages and attorney's fees. This was the first case in which a United States Circuit Court of Appeals explicitly ruled that private citizens have a right to film police officers in public spaces. The case drew media attention across the United States, and was also cited favorably by other United States Circuit Courts of Appeals that reached similar conclusions in other cases.
