Duplicity (law)

Duplicity is the error committed when the charge (known as a count) on an indictment describes two different offences. An indictment may contain more than one count, but each count must allege only one offence, so that the defendant (and the jury) can know precisely what offences he is accused of. If a count is poorly drafted so that it alleges two offences, it is said to be duplicitous. A duplicitous count is defective and must be quashed by the judge, unless the judge permits the count to be amended so that it only alleges one offence, or is split into two counts. If a duplicitous count is not noticed until after the defendant has been convicted on it, the verdict may well be void.

This is a completely different situation from when two different counts each allege the same offence, which is sometimes wrongly referred to as duplicity.

Law

Law is a system of rules that are enforced through social institutions to govern behavior. Laws can be made by a collective legislature or by a single legislator, resulting in statutes, by the executive through decrees and regulations, or by judges through binding precedent, normally in common law jurisdictions. Private individuals can create legally binding contracts, including arbitration agreements that may elect to accept alternative arbitration to the normal court process. Canon law

Canon law is the body of laws and regulations made by ecclesiastical authority (Church leadership), for the government of a Christian organization or church and its members. It is the internal ecclesiastical law governing the Catholic Church (both Latin Church and Eastern Catholic Churches), the Eastern and Oriental Orthodox churches, and the individual national churches within the Anglican Communion. The way that such church law is legislated, interpreted and at times adjudicated varies widely among these three bodies of churches. In all three traditions, a canon was originally a rule adopted by a church council; these canons formed the foundation of canon law.

Etymology

Greek kanon / Ancient Greek: κανών,Arabic Qanun / قانون, Hebrew kaneh / קנה, "straight"; a rule, code, standard, or measure; the root meaning in all these languages is "reed" (cf. the Romance-language ancestors of the English word "cane").

Canons of the Apostles

The Apostolic Canons or Ecclesiastical Canons of the Same Holy Apostles is a collection of ancient ecclesiastical decrees (eighty-five in the Eastern, fifty in the Western Church) concerning the government and discipline of the Early Christian Church, incorporated with the Apostolic Constitutions which are part of the Ante-Nicene Fathers In the fourth century the First Council of Nicaea (325) calls canons the disciplinary measures of the Church: the term canon, κανὠν, means in Greek, a rule. There is a very early distinction between the rules enacted by the Church and the legislative measures taken by the State called leges, Latin for laws.

Smallville (season 2)

Season two of Smallville, an American television series developed by Alfred Gough and Miles Millar, began airing on September 24, 2002, on The WB television network. The series recounts the early adventures of Kryptonian Clark Kent as he adjusts to life in the fictional town of Smallville, Kansas, during the years before he becomes Superman. The second season comprises 23 episodes and concluded its initial airing on May 20, 2003. Regular cast members during season two include Tom Welling, Kristin Kreuk, Michael Rosenbaum, Sam Jones III, Allison Mack, Annette O'Toole and John Schneider. John Glover who was a recurring guest in season one was promoted to regular for season two. At the end of season one, Eric Johnson, who portrayed Whitney Fordman, had left the show.

Season two picks up directly where season one ended, with Clark (Welling) dealing with the aftermath of the tornadoes that hit Smallville. This season, Clark finally learns who he is and where he comes from, but must also acknowledge a potential destiny set into motion by his biological father that could change his life and the lives of those around him forever. Clark's relationship with Lana Lang (Kreuk) becomes increasingly closer, straining his friendship with Chloe Sullivan (Mack). Clark's best friend, Pete Ross (Jones III), learns Clark's secret this season.
