Canadian Union of Public Employees

The Canadian Union of Public Employees (CUPE, French: Syndicat canadien de la fonction publique) is a Canadian trade union serving the public sector - although it has in recent years organized workplaces in the non-profit and para-public sector as well. CUPE is the largest union in Canada, representing some 650,000 workers in health care, education, municipalities, libraries, universities, social services, public utilities, transportation, emergency services and airlines. CUPE is still twice the size of the new union Unifor (a merger of the CAW union and the CEP), which represents around 350,000 members versus CUPE's 657,000. Over 60% of CUPE's members are women, and almost a third are part-time workers. CUPE is affiliated with the Canadian Labour Congress and is its greatest financial contributor.

History

CUPE was formed in 1963 in a fashion resembling industrial unionism by merging the National Union of Public Employees (NUPE) and the National Union of Public Service Employees (NUPSE). The first national president was Stan Little, who had previously been the president of NUPSE. Having led public sector unionism through a period where almost no workers had the right to strike, Little has been credited with bringing public sector unions "from collective begging to collective bargaining." By the time of Little's retirement, CUPE had already grown to 210,000 members and had eclipsed Steel as the largest affiliate to the Canadian Labour Congress.

Canadian Union of Public Employees, Local 963 v New Brunswick Liquor Corp, [1979] 2 SCR 227 is a leading case decided by the Supreme Court of Canada. This case first developed the patent unreasonableness standard of review in Canadian administrative law.

Background

The unionized employees of the New Brunswick Liquor Corporation, represented by the Canadian Union of Public Employees, went on strike. During the strike the Liquor Corporation brought in the managers to do the work of the strikers. The union brought a suit against the employers claiming that their actions violated section 102(3) of the Public Service Labour Relations Act. At the same time, the employer also claimed that the union was in breach of the Act due to their picketing. The relevant section of the Act stated:

The New Brunswick Public Service Labour Relations Board found that the Liquor Corporation had violated section 102(3), and at the same time found that the union had also violated the Act by picketing. The Board ordered both sides to cease their actions.

CUPE 3902

The Canadian Union of Public Employees, Local 3902 (CUPE 3902) is a labour union local representing sessional lecturers and teaching assistants (TAs) at the University of Toronto, Canada.

Organization

CUPE 3902 is organized into five bargaining units:

  • Unit 1: all post-doctoral fellows, graduate students in the School of Graduate Studies and undergraduate students in the University of Toronto employed as teaching assistants, teaching fellows, demonstrators, tutors, markers, instructors, teaching laboratory assistants, Chief Presiding Officers, invigilators and part-time lecturers.
  • Unit 2: all persons employed by Victoria University on contracts of less than one-year as lecturers, demonstrators, tutors, markers, graders or teaching/laboratory assistants.
  • Unit 3: all non-student academic staff employed on contracts of less than one-year as lecturers, demonstrators, tutors, markers, graders or instructors or laboratory assistants.
  • Unit 4: all persons employed by the University of St. Michael’s College on contracts of less than one-year as lecturers, demonstrators, tutors, markers, graders, teaching/laboratory assistants or continuing education instructors.
