Self-Defense Is Legal in North Carolina

But then I thought it was. Winston-Salem death investigation ruled act of self-defense | FOX8 WGHP

The investigation into the death of a 58-year-old man in Winston-Salem has been ruled as an act of self-defense, according to the Winston-Salem Police Department.

This incident took place at the end of May, and it only took this long, for the police to complete their investigation, and the DA to sign off on a finding of self-defense.

Investigators consulted with Forsyth County District Attorney Jim O’Neill and determined that the circumstances behind Mendoza’s death were an act of self-defense. No charges have been filed as a result.

Self-Defense Is Legal in North Carolina

North Carolina man not charged in deadly shooting; ‘acted to defend himself’

According to the Asheville Police Department, at around 12:07 a.m. Sunday officers were called to Rankin Avenue near College Street for a reported shooting. At the scene, they found Andy Garcia Porras dead in the roadway and multiple others who were hit or grazed by gunfire.

After investigating the shooting, police, in consultation with the Buncombe County District Attorney’s Office, determined the shooting was in self-defense.

It started when a group of men were seen harassing some women. This was witnessed by the bouncer to a club. The men were then denied entry into the club. Gee, punishing bad behavior? Must be some kind of Conservative club.

One of the guys left to get a gun. It would turn out to be the last bad decision he would make. In the meantime a patron of the club came to help the bouncer; the patron was armed.

When Porras got back, with his gun, a gunfight ensued. Both shooters and several other people were hit.

“The evidence indicates that the patron was not the aggressor and acted to defend himself during a rapidly escalating and dangerous situation,” police said in a news release.

The police go on to make a bland statement about tragedy and the sanctity of all life. Clearly the dead guy didn't feel that way. He was willing to kill because he didn't think his bad behavior - harassing women - should be punished in any way. He didn't get his way, and like a two-year-old child was throwing a tantrum, except his tantrum included a loaded weapon.

It is hard for me to see this as anything but Good Guys 1, Bad Guys 0. I expect that in the next day or two we will hear for this guy's family, about how he was a choir boy, and getting ready to go to college and change the world or whatever, and we will hear how they don't like legal self-defense.

Don't Bring an Axe to a Gunfight

Things won't go well for you if you do. Homeowner fatally shoots intruder armed with axe in Duplin County

The residents of the home were confronted by a man armed with an axe trying to enter their home through the back door, and in response, the homeowners fired multiple shots through the door,s striking the intruder. Authorities say that an axe was located, along with other weapons, near White's body, as well as damage to the back door.

The southern edge of Duplin County, North Carolina, is about a 50 mile drive north of Wilmington.

The investigation is not over, but this seem to clearly be self-defense, at least to me.

Self-Defense Is Legal in North Carolina

It took the DA from early January to April 25th to make that determination. Deadly Durham shooting at Lions Court home ruled self-defense

According to the Durham Police Department, officers responded on Jan. 8 at around 1:30 a.m. to a report of a gunshot wound at a home on Lions Court near the intersection of Sundial Circle. They found 50-year-old Judah Taylor, who had been shot. He was pronounced dead at the scene.

This length of time seems to be on par with other incidents ruled self-defense in North Carolina, even if it seems long to me.

Police said the case was reviewed by the Durham County District Attorney and determined to be self-defense.

Somehow I missed this incident when it originally took place.

Another Wrong-House SWAT Raid

Someday the cops in America will take some action to ensure they are in the right place, before they execute a SWAT raid, but that isn't going to start anytime soon. North Carolina SWAT Destruction.

When a SWAT team raids a family’s home in the middle of the night, the officers ought to be very sure they have the right house. But no officer did that the night a SWAT team raided an innocent family’s home in Willard, North Carolina, in April 2024. And the officers had indeed raided the wrong house. Officers terrorized the family with flash-bang grenades, shattered glass, and aimed guns at children as they were ordered out of their bedrooms.

They even took sledge hammers to the outside of the house. Why? Because don't disrespect their authority peasant, be glad they didn't destroy more stuff.

Why the raid? The same kind of car was parked in front of the house. It had a different license plate and a different VIN number, but you can't expect cops to check that kind of thing. They're SWAT after all. Brawn not Brain. Watch the video; it is only 5 minutes.

North Carolina Senate Passes Constitutional Carry

All the usual suspects are upset about it. North Carolina bill passes to allow to carry conceal weapon without permit

“Nobody wants to shoot and kill anyone,” Senator Eddie Settle said. “We don’t want to have to carry one but as long as evil is in this world, it’s going to be there and the evil are the ones who are going to get guns regardless of any laws that we make.”

Republican supporters of the bill say it simply allows law abiding citizens to exercise their Second Amendment and keep their families safe. Democrats say it puts everyone in danger.

The bill now goes to the North Carolina House.

You Can't Just Shoot People

Not even if they stole from you. Nash County homeowner shot at car after theft from his truck, hitting teen driver in head, sheriff says

"Every bullet comes with a lawyer attached."

This is one of the more insane stories about a homeowner going out to "confront" someone breaking into his vehicle I've seen in a while, and see a fair few of them. Yes, I know you are pissed off. The Law doesn't care about your feelings. That headline contains most of the relevant information.

Spring Hope, North Carolina is about a 35 mile drive east of Raleigh.

Zachary Bryant, 30, is facing several charges after a 15-year-old was shot in the head and is listed in critical condition, Nash County deputies said Sunday.

He didn't even have a gun on him when he went outside. He had to go back into the house to get it.

Bryant then went into his home, put on clothes, grabbed a handgun and flashlight and went back outside, deputies said.

Bryant checked his truck and noticed some tools were missing, deputies said.

He then fired at a car that was "similar to that from before." He wasn't even sure, couldn't be sure, it was the same people who stole from him. They were in a similar vehicle. They were on a main road near his house. He opened fire.

He struck the 15-year-old driver in the head, causing the car to crash. The cops didn't even mention if the 4 teens in the car had stolen from Bryant, because that is not relevant to the charges.

Deputies said Sunday that Bryant was not in the path of the car and “had no concern of the car hitting him” when he fired the shots.

Deputies said Sunday that the situation does not meet the criteria for justified use of deadly force.

Bryant is now charged with assault with a deadly weapon with intent to kill and inflicting serious injury and assault with a deadly weapon with intent to kill.

So he will now face the very real prospect of losing years of his life, his ability to legally own firearms, all over "some tools." If they were that valuable, maybe not leave them in your vehicle, or maybe park your vehicle somewhere secure.

What Would You Do If a Guy With a Knife Threatened You?

Was this another failure of the victim-selection process? Man shot in Wilmington, NC, died in act of self-defense, police say

A woman shot [36-year-old James] Scott after he pulled out a knife, came towards her and threatened to kill her, according to the news release. A firearm, knife, shell casing and cell phone were located at the scene. Detectives determined that Scott was the initial aggressor in the incident.

She was in a group of people. Maybe he thought she was the easiest target. He was wrong.

Police detained three people for questioning, but ultimately no one was arrested.

Self-defense is a human right, and North Carolina is not New Jersey.

It Was All a Misunderstanding

You're at a gas station minding your own business when someone douses you with gasoline, and then hits you with his car. I would say you're justified in viewing him as a threat.

Carry, North Carolina is suburban Raleigh, being about 5 miles west of downtown.

According to authorities, Trombley approached a man on January 30th, just before 6:00 a.m. at the Exxon Refuel station on Maynard Road, near Chapel Hill Road.

Trombley then allegedly poured gasoline over this man and hit him with his car. The man then shot Trombley in the chest in what police believe was an act of self-defense.

Trombley spent several days in hospital, and then was arrested on two counts of assault with a deadly weapon with intent to kill. Despite the charges he was granted bail in the amount of $75,000.

He has a handful of prior convictions and pending charges, some include DWI, drug charges, and fleeing from officers. He declined a court-appointed attorney Tuesday, but it's unclear who will represent him on this latest round of charges.

Color me shocked.

People You Know Can Be a Threat

The gun-hating part of the left loves to go on at length about how if you own a gun, you are more likely to shoot someone you know than a complete stranger. There is a good reason for that. Just because you know someone does not guarantee that they will never be a threat to you.

Goldsboro, North Carolina is about an hour drive southeast of Raleigh.

There were two people in a home, at 6 PM, when Mr. James decided to break in. He knew at least one of the people in the home.

Investigators said James was suspected of breaking and entering to terrorize a residence when he was shot. The shooting was in self-defense.

There is not a lot of information provided on the two people Mr. James was going to terrorize, because they have not been charged with a crime. But if I had to guess, and it is only a guess, I would say that this is a domestic dispute situation, and Mr. James doesn't understand the statement, "It's over."

The list of people you know can be quite large. Ex-boyfriends, ex-girlfriends, disgruntled ex-employees, the creepy guy from your favorite coffee shop, the coworker turned into a stalker, etc. Just because you know them, does not make them automatically friendly.

While police were investigating based on ShotSpotter reports, Mr. James arrived at UNC Health Wayne with gunshot wounds. He was transferred to ECU Medical Center and was listed in critical condition.

This is also clearly an instance in which the victim-selection process failed.

Self-Defense Is Legal in North Carolina

Given that this incident happened at the beginning of November, I would say the DA made this determination fairly quickly.

Zebulon, North Carolina is about a 30 minute drive east of Raleigh.

Brown reportedly tried to break into several cars parked outside, threatened a customer in the parking lot, and physically fought with the clerk before the shooting.

The sheriff's office presented all the evidence to the Johnston County district attorney, who made the decision not to file any charges.

A store clerk was killed in that store in 2016, and a 2nd person injured. I would say that they have a vested interest in being armed in self-defense.

Another Failure of the Victim-Selection Process

The bad guys are not getting the memo that homeowners are armed. Lenoir County homeowner shoots suspect during attempted vehicle break-in

A man who is suspected of breaking and entering into a vehicle at a home on Will Baker Road was shot by the homeowner and is in serious condition at a Greenville hospital.

A man who identified himself as Ryan Lee Burd, 39, of Morrisville was discovered on the side of Will Baker Road by Lenoir County Sheriff’s Office deputies, who were responding to a breaking-and-entering call.

Lenoir County, North Carolina is about an hour and a half drive southeast of Raleigh.

The guy who got shot was airlifted to a trauma center, and is in serious condition.

The DA will make any determination on charges, but as far as I can tell, the homeowner was not arrested.

That is because self-defense is a human right, and it seems to be your legal right in North Carolina.

A Good Guy With a Gun Stops a Bad Guy

Isn't that the thing that the gun-hating Left says never happens? Would-be robber shot and killed in Gastonia store

A would-be bad guy walks into a store in the evening, pulls out a gun, threatens an employee, and demands cash.

A customer in the store was also armed and shot Almodovar, police said. He was taken to Caromont Regional Hospital where he died from his injuries. No one else at the store was injured, and no arrests have been made.

No was arrested because defense of self, and others, is legal in the Great State of North Carolina.

Gastonia, North Carolina is about a 20 mile drive west of downtown Charlotte.

The investigation is ongoing, but police have confirmed that the shooter has a concealed carry license.

Hurricane Helene - Aftermath in North Carolina

Several people on social media have noted the lack of interest, mostly, from the American media about Hurricane Helene and its aftermath. Hurricane Helene leaves 'biblical devastation' in North Carolina - BBC News

A clearer image of the destruction in hard-hit North Carolina emerged on Sunday, where, after barrelling through Florida and Georgia, Helene brought torrential rain and swamped towns with flooding and mudslides.

More than 400 roads are closed in the state, where 11 people have died. Homes have been destroyed, towns have been cut-off, water systems are down and hundreds of thousands are without power.

"This storm has brought catastrophic devastation... of historic proportions," Governor Roy Cooper said.

My theory is that the journalists at the WaPo, the NY Slimes, an media headquartered in California, etc. don't know people in North Carolina, so the suffering of people there don't matter.

If someone is firing warning shots in your direction ...

That is a hint that you should leave. He didn't leave. Rockingham homeowner shoots would-be intruder: Sheriff’s Office

Rockingham, North Carolina is about a 70 mile drive southeast of Charlotte.

On Thursday, August 22, deputies were called to a home on McDonald Church Road. A homeowner reportedly fired shots to try to scare off someone trying to get into his home.

Despite the previous shots, officials say the suspect kept trying to get into the home and the homeowner shot the man.

He had to be airlifted to a trauma center. Charges have not been announced. Sadly, felony stupidity is not against the law in North Carolina.

When Seconds Count, Police Are (20) Minutes Away

And self-defense IS legal in North Carolina. No charges to be filed in Dowd Road fatal shooting - Sandhills Sentinel

It took three months to make the "self-defense is legal" determination, but they did get there. Then again, this was not your typical case.

The determination of justification is based on the reasonable belief of the homeowner, considering the totality of the facts known to the homeowner at the time of the shooting, and the North Carolina Castle Doctrine, according to Fields. The homeowner’s actions were deemed justifiable under the North Carolina Castle Doctrine, which allows for the use of defensive force in situations where there is a perceived imminent threat to personal and family safety within one’s home or property.

A remote home, a family consisting of a husband, wife, and three kids, and a stranger taking photos of the kids and the property.

The husband approached the stranger, and asked him to leave. The stranger became belligerent, so the husband armed himself and the wife called 911. About 13 minutes later, she called 911 a second time. She had also armed herself. She pleaded for the cops to get there as quickly as possible.

More than 20 minutes passed from the time of the first call until law enforcement arrived. At the time of the initial call, deputies working the area were on the scene of an unrelated life-threatening medical emergency, delaying their response.

That is not a dig against cops. They cannot be everywhere. They do not have unlimited resources. That is just reality. In this case it meant that this family was on its own.

The shooting took place just after the 2nd 911 call, but before police arrived on the scene.

For all of the insanity, there is a real lesson. Don't mess with people on their own property, especially when they are armed. If an armed homeowner asks you to leave his property, you should leave his property.

It Seems Self-Defense Is Legal in North Carolina

I thought it might be. Fatal shooting in New Hanover neighborhood early Saturday morning

He rang the bell, and was pounding on the door at 3 AM. The homeowner, Rodney Jester opened the door, and David Rose attempted to force his way inside. He shot Jester.

Jester's wife attempted to shut the door and Rose tried to forcibly enter, according to the release. Jester grabbed his gun and shot once through the door, striking Rose in the head.

Jester was taken to the hospital. Rose was taken to the morgue.

"Under our state's laws, individuals have the right to defend themselves when they believe they are in imminent danger," [New Hanover County Sheriff Ed] McMahon said in the release.

That press release was issued after they conferred with District Attorney Ben David. The homeowner is not facing any charges, though the Sheriff's office is still investigating.

Don't Bring a Pizza Cutter to a Gunfight

And neighbors were shocked. Man armed with pizza cutter charged at Nash deputy before being shot, sheriff says

I'm not even surprised that I got to write that post title.

Nash County, North Carolina is about 20 miles east of Raleigh.

A couple was going about their morning routine when it was interrupted by a stranger, who burst into their kitchen and stole the pizza cutter out of the sink.

According to Sheriff Keith Stone, the homeowner provided a description of the man who had broken into his home and stolen some items. The man then took off on foot down US-64 Alt. and encountered the deputy on Big Jim Road.

Stone says the man, who was armed with a pizza cutter, then charged at the deputy, who fired one shot.

The deputy was not injured. The guy with the pizza cutter is in critical condition.

As for the neighbor homeowner, he is shocked to discover that he is not protected by his zip code.

"I'm still shocked [because] you just never expect this," Vandermeulen said.

I don't usually features stories about cops defending themselves, because that is not what I'm focused on, and it is a good way to get wrapped up in controversy, but this story is too perfectly bizarre to ignore.

32-year-old Awet Hagos, from Eritrea, was arresting in North Carolina after he barricaded himself in his home for a 4-hour standoff.

So how did a 32-year-old terrorist end up living in North Carolina?

Probably the answer is, when you just stop enforcing immigration law completely — as the Biden administration seems to have done — and throw the doors open to millions of foreigners without limit, a certain percentage of those arrivals will be, shall we say, problematic.

When Did Meeting Random People from the Internet Become a Good Idea?

This story is about using social media to purchase items from strangers. Raleigh police respond to shootout on Peter Court, police say

Of course the people who showed up were looking to ambush the concealed carry license holder, not sell or buy items.

Two men approached the victim in the parking lot. One man pulled out a firearm, leading the victim to pull out his firearm and exchanging gunfire. The two men then left the area.

No one was hurt, though there was some property damage. The bad guys ran like rabbits. (Hat tip to Concealed Nation.)

And the question that forms the title to this post is a trick question; it isn't a good idea.
