Are you a hospitality business? Did you know that from 1 October 2024, employers are under a new obligation to allocate and distribute to their staff 100% of tips, service charges and gratuities received into the business. A new statutory Code of Practice has also been introduced to guide employers on how to do this. Employers should assess their organisation to determine whether it will impact them. Where qualifying tips are paid at, or are otherwise attributable to, a place of business on more than an occasional and exceptional basis, a tips policy will have to be established which must be distributed to all workers to whom it applies and re-distributed if changes are made to it. Where non-qualifying tips are paid on more than an occasional and exceptional basis at an employer’s place of business, we recommend introducing a Tips Policy Exemption Statement. This is due to the requirement under the Code that employers in these circumstances inform all workers at the place of business that they are not required to have a written policy for the place of business and why they are not (i.e. because qualifying tips are not received). Great news for millions of workers in the hospitality, retail, and transport industries 𝗦𝘁𝗮𝗿𝘁𝗶𝗻𝗴 𝘁𝗼𝗱𝗮𝘆, businesses in the UK are obligated by law to pass on all tips and service charges to their staff! Whether tips are given by card or cash, employees must receive their fair share by the end of the following month. This long-awaited legislation is expected to annually direct millions into workers' pockets – money that was previously at risk of being withheld. While this is a major step forward for employee rights, it does add an administrative burden for businesses already facing challenges. Transparent systems will be key to compliance. 🏆 For workers, this is a well-deserved recognition of their hard work. Employers must now adapt to ensure they are fairly distributing tips.
