Is it time to retire the term “nonlawyer” from our legal vocabulary? Picture a legal industry where every professional’s contribution is acknowledged as well as respected. This vision is what Olga Mack and Damien Riehl are advocating for with their recent petition to the American Bar Association (ABA). The petition, which has started debate on LinkedIn, calls for the ABA to replace “nonlawyer” with a term that reflects the diverse roles within the legal profession. Mack and Riehl argue that “nonlawyer” perpetuates negative stereotypes and hierarchies, marginalising indispensable professionals such as paralegals, CTOs, and COOs. They compared parallels with the medical field, where non-doctors are termed “allied medical professionals,” they emphasise the need for precise and inclusive language. Legal scholars like Professors David Wilkins and Bill Henderson support this initiative, highlighting the evolving landscape of the legal profession and the critical importance of multidisciplinary roles. By addressing this seemingly small but rather significant issue, we can create a more inclusive and accurate representation of the many professionals essential to delivering quality legal services.
