Have you been asked questions about an incident?

It’s an unfortunate reality of our sport that it is dangerous and that incidents occur. Where an incident occurs, participants and officials are sometimes contacted for information by public authorities (police, safety investigators, etc.) and third parties (media, lawyers, insurers, etc.) 

Information in relation to significant incidents can be sensitive to those involved and their families. It can unfortunately also be used as a basis for taking action against those involved in the sport. 

Motorsport Australia’s priority is that information is treated sensitively, our members are protected and that Motorsport Australia is well placed to deal with any legal or insurance issues which may arise. As a general rule, information should be treated confidentially and should only be disclosed where required by public authorities, as part of the process of responding to the incident or as otherwise required by law.

Where you are requested to make a comment about an incident by a third party, you should first contact the clerk of course, person in charge of the incident or Motorsport Australia and check if this is OK. 

You should err on the side of caution as it is often difficult to know how the information you are giving out will be used immediately following an incident. It is usually appropriate for you to ask for time to do this. 

Particularly where an incident is serious, it is important to ensure that a co-ordinated response is given and that the person making a comment understands the entire picture.  This may also mean that there is someone else better able to comment.

Motorsport Australia and the Australian Officials Commission have put together the Motorsport Australia Social Media Policy for the use of Social Media. The Policy has been developed to outline the use of Motorsport Australia content on personal social media channels and to minimise the risks of inappropriate social media use by all Motorsport Australia representatives. The Policy is useful to send out to officials prior to the meeting or to post up in a visible location during the event.

The Victorian State Government has made amendments to the Working with Children Check Act 2005 that will come into effect on 1 August, 2017. 

These changes will now require ALL Victorian Officials to obtain a Working with Children Check as part of their licence. These amendments are being made following a Royal Commission into Institutional Responses to Child Sexual Abuse.

For those officials who already hold a valid check, details will need to be emailed to [email protected]

The email should include:
– Your full name;
– Motorsport Australia licence number;
– Working with Children Check number/reference;
– Working with Children Check expiry date; 
– a scanned copy/photograph of the card.

For those that don’t currently have a check, one can be obtained free of charge from the following link.

To begin the application, hit the blue ‘start application’ box at the bottom of the page. Once the online application is complete, you will need to visit an Australia Post outlet to verify your identity free of charge. Once you receive approval, please email the same details as above to [email protected]

These checks have been compulsory for Victorian Officials since 1 August, 2017. Victorian officials must provide details of their WWCC in order to participate in Motorsport Australia permitted events. 

Presently Victoria is the only state expanding their definition of ‘direct contact’ and removing references to ‘Supervision’, however Motorsport Australia anticipate that these amendments will be adopted by other State Governments over the next 12 months. Motorsport Australia recommends officials in other States be pro-active and obtain a check.
