Starting a company in France as a foreigner can feel like navigating a labyrinth 🌪 Here’s how I did it for VAir without losing my sanity — yes, we are now officially registered! 💭 𝐂𝐡𝐨𝐨𝐬𝐢𝐧𝐠 𝐭𝐡𝐞 𝐫𝐢𝐠𝐡𝐭 𝐥𝐞𝐠𝐚𝐥 𝐬𝐭𝐫𝐮𝐜𝐭𝐮𝐫𝐞 depending on the number of founders, the nature of the business, and financial requirements. As a startup, we opted for the Société par Actions Simplifiée (SAS) due to several advantages:  → Flexibility in defining our management and decision-making processes.  → Protection of our personal assets by limiting liability to our capital contributions.  → No minimum capital requirement. 💡 𝐔𝐧𝐝𝐞𝐫𝐬𝐭𝐚𝐧𝐝𝐢𝐧𝐠 𝐭𝐡𝐞 𝐫𝐞𝐪𝐮𝐢𝐫𝐞𝐦𝐞𝐧𝐭𝐬, namely the registration dossier with several supporting documents:  → 𝘍𝘰𝘳𝘮𝘶𝘭𝘢𝘪𝘳𝘦 𝘥𝘦 𝘥é𝘤𝘭𝘢𝘳𝘢𝘵𝘪𝘰𝘯 𝘥𝘦 𝘤𝘳é𝘢𝘵𝘪𝘰𝘯 𝘥’𝘦𝘯𝘵𝘳𝘦𝘱𝘳𝘪𝘴𝘦 (Business creation declaration form)  → Original copy of the by-laws  → Proof of address: utility bill, domiciliation certificat, lease contract  → Copy of the capital deposit certificate → Copies of ID. If the CEO is not a French citizen, it has to be one of the following residence permits: 𝘱𝘢𝘴𝘴𝘦𝘱𝘰𝘳𝘵 𝘵𝘢𝘭𝘦𝘯𝘵 "𝘱𝘳𝘰𝘫𝘦𝘵 é𝘤𝘰𝘯𝘰𝘮𝘪𝘲𝘶𝘦 𝘪𝘯𝘯𝘰𝘷𝘢𝘯𝘵", 𝘱𝘢𝘴𝘴𝘦𝘱𝘰𝘳𝘵 𝘵𝘢𝘭𝘦𝘯𝘵 "𝘤𝘳é𝘢𝘵𝘪𝘰𝘯 𝘥'𝘦𝘯𝘵𝘳𝘦𝘱𝘳𝘪𝘴𝘦", 𝘤𝘢𝘳𝘵𝘦 𝘥𝘦 𝘴é𝘫𝘰𝘶𝘳 "𝘦𝘯𝘵𝘳𝘦𝘱𝘳𝘦𝘯𝘦𝘶𝘳-𝘱𝘳𝘰𝘧𝘦𝘴𝘴𝘪𝘰𝘯 𝘭𝘪𝘣é𝘳𝘢𝘭𝘦", 𝘱𝘢𝘴𝘴𝘦𝘱𝘰𝘳𝘵 𝘵𝘢𝘭𝘦𝘯𝘵 𝘧𝘢𝘮𝘪𝘭𝘭𝘦, 𝘤𝘢𝘳𝘵𝘦 𝘥𝘦 𝘳é𝘴𝘪𝘥𝘦𝘯𝘵, 𝘤𝘢𝘳𝘵𝘦 𝘥𝘦 𝘴é𝘫𝘰𝘶𝘳 "𝘷𝘪𝘦 𝘱𝘳𝘪𝘷é𝘦 𝘦𝘵 𝘧𝘢𝘮𝘪𝘭𝘪𝘢𝘭𝘦" 🧞‍♂️ 𝐌𝐞𝐭𝐢𝐜𝐮𝐥𝐨𝐮𝐬𝐧𝐞𝐬𝐬 𝐚𝐧𝐝 𝐫𝐞𝐬𝐢𝐥𝐢𝐞𝐧𝐜𝐞. Our application for a capital deposit was rejected by several banking services because of my co-founder's 1-year 𝘱𝘢𝘴𝘴𝘦𝘱𝘰𝘳𝘵 𝘵𝘢𝘭𝘦𝘯𝘵 visa and not a biometric residence permit 😳 Fortunately, we found Qonto, a licensed French business financing solution, which took us through the process in 3 working days. We also faced rejection in our company registration process because the administrative staff mistakenly declined my residence permit 𝘱𝘢𝘴𝘴𝘦𝘱𝘰𝘳𝘵 𝘵𝘢𝘭𝘦𝘯𝘵 "𝘱𝘳𝘰𝘫𝘦𝘵 é𝘤𝘰𝘯𝘰𝘮𝘪𝘲𝘶𝘦 𝘪𝘯𝘯𝘰𝘷𝘢𝘯𝘵", a scheme set up by 𝘓𝘢 𝘍𝘳𝘦𝘯𝘤𝘩 𝘛𝘦𝘤𝘩 mission to promote the creation of startups in France. In fact, they didn't know that a person with a Russian passport and such a residence permit had full rights to start a business in France 🤯 Choosing LegalPlace to take meticulous care of all the necessary documents streamlined the registration process.
