Hannah Montana star Mitchel Musso's theft and public intoxication charges dismissed in court

"I think it goes without saying at this point that though I was not party to a Ruffles heist, I still absolutely love me my Ruffles," the former Disney star told EW after being cleared of potato chip theft allegations.

The public intoxication and theft charges against former Disney star Mitchel Musso have been officially dismissed in court, EW has confirmed.

Musso, an actor and musician famous for starring alongside Miley Cyrus on Hannah Montana, was arrested on Aug. 26 in Rockwall, Tex. At the time, officers responding to "a disturbance" at a hotel were told that an individual "appeared intoxicated" and had entered the SpringHill Suites Dallas Rockwall and started eating a bag of chips without paying, according to a press release from the police department. 

The responding officers found the 32-year-old actor outside of the hotel, where they took him into custody. After a night in jail, Musso was released after posting a $1,000 bond. 

"In our previous conversation, I foretold that the truth would inevitably come to light, and indeed, it has," Musso said in a statement to EW on Thursday, referencing a previous interview shortly after his arrest. The actor extended "heartfelt gratitude to my family and my dedicated team" after news that the charges were dropped by prosecutors, calling the ordeal a "challenging period."

"Despite the less-than-ideal circumstances, my sincere wish is for the well-being of everyone involved as we move forward. My current focus is on the completion of my upcoming album, and with the resolution of the SAG-AFTRA strike, I am now also directing my attention to forthcoming film and television projects," the actor said, sharing that he was also collaborating on the creation of a cutting-edge solar farm in Tatums, Okla.

"Also I think it goes without saying at this point that though I was not party to a Ruffles heist, I still absolutely love me my Ruffles," Musso joked about being cleared in the alleged potato chip theft.

Speaking to EW in August, Musso denied that he ever opened the bag of chips, claiming that a hotel employee who appeared "extremely disgruntled" and had "unhinged behavior," refused his service because he was dressed only in board shorts.

"I was absolutely not drunk or drinking, and there was 100% no theft," Musso said at the time. "It's unfortunate, it's a misunderstanding."

While the police report states that when staffers asked the actor to pay, he became "verbally abusive,” Musso told a different story.

"I was the one who was being verbally abused and also harassed,” he said, explaining that he went in for snacks after leaving a docked boat on the harbor. He added that the employee who was "agitated from the get go" grabbed the chips out of his hand. “Someone ripping something out of your hand is not the most polite manners to have in this situation."

A routine records check revealed that Musso had several outstanding traffic warrants, so he was additionally charged for an expired registration, failure to display a driver's license, and violating a promise to appear. The "Welcome to Hollywood" singer told EW that the two unpaid tickets from 2019 were "ultimately the reason why they arrested me."

He explained, "I haven't lived in Rockwall for years and I guess they'd been sending it to my old house there. And it had become a warrant and they used it against me. So since then, all of those warrants have been paid and the matter has been resolved."

Those charges against Musso are not noted in the arrest complaint, provided to EW. A representative for the Rockwall Municipal Court confirmed that the additional charges, outside of public intoxication and theft of an item under $100, have not been dismissed.
